INSTITUTIONS OF PRIVATE LAW

The course aims to provide a critical knowledge of the main issues and problems of private law in light of the recent reforms that have contributed to the ever-increasing proliferation of special legislation and the loss of centrality of the civil code. In this perspective, a particular look will be directed to European law, which has led to a radical renewal of the framework of sources by introducing in our system subsystems designed to support, and sometimes replace, domestic law. In this path, the teaching aims to provide 1) a thorough knowledge of the fundamental notions of private law in the Italian and European legislative framework; 2) the ability to contextualise, analyze and critically interpret sources of a different nature (European directives and regulations, our Constitutional Charter, the civil code, the principles of law enunciated by the jurisprudence of the European Court of Justice and the national court); 3) the lexical and conceptual tools necessary for the study of private law and useful for acquiring good exhibition skills in written and oral form. Expected learning outcomes:
- Analysis and in-depth analysis of the main institutions of private law with particular reference to the system of sources, the criteria of interpretation, the right of persons and family, the law of succession, real rights, the regulation of obligations and contracts in general, to typical and atypical contracts and to the civil liability system. - Acquisition of technical language and a theoretical framework suitable for depicting and ordering the subject matter. - Ability to interpret the regulatory provisions in full autonomy and to frame the concrete cases, paying particular attention to the main jurisprudential orientations and to the broader European context. - Ability to identify possible solutions in case of conflict of subjective legal situations through a critical analysis of the main jurisprudential orientations and of the most consolidated doctrinal guidelines in the light of the changed economic, social and regulatory framework. - Ability to present the acquired knowledge in the field of private relations in a complete and critical way, using an appropriate technical language. Capacity for refutation and comparison. - Ability to apply and exploit the knowledge acquired during the course in the context of insolvency procedures, conference reports, seminars, professional interviews, masters.

The course of Private Law Institutions is aimed at allowing students to learn the fundamental notions of private law understood as that complex of rules that govern the intersubjective relationships between the individual members in their patrimonial sphere but also personal and family. Particular attention will be paid to the right of people - physical and legal - to which the system recognizes the quality of subjects of law, that is, holders of active and passive legal situations. Family law will also be studied in depth, consisting of a set of legal rules that concern not only the traditional family based on the marriage of a heterosexual couple, but also civil unions between persons of the same sex and de facto cohabitation, recently debated reforms. The law of succession will also be addressed, whose provisions are aimed at regulating the personal and patrimonial relations of the individual after death, and the subject of real rights, that is rights over things, with particular reference to the ways of purchasing and of transfer of the right of ownership between the living, as well as the real rights of enjoyment, possession and usucation. A special look will also be given to the general regulation of obligations and the contract and to the main rules on individual contracts and other sources of obligations. L’insegnamento di diritto del mercato del lavoro ha l’obiettivo di approfondire gli istituti finalizzati a disciplinare l’incontro tra domanda e offerta di lavoro.
In quest’ambito saranno analizzati gli uffici di collocamento pubblico, le agenzie di lavoro private e le figure per il sostegno e l’accompagnamento verso il nuovo posto di lavoro. Tra queste spiccano le misure di sostegno economico quali l’indennità economica di disoccupazione, il reddito di cittadinanza, Cassa integrazione guadagni (Politiche passive del lavoro). Le misure volte alla riqualificazione, formazione e re/inserimento del personale (Politiche attive del lavoro). La sezione relativa all’offerta di lavoro si compone di tutte le tipologie di rapporto di lavoro con i quali il lavoratore possa essere assunto (subordinazione, contratto di lavoro a tempo determinato, contratto di lavoro a tempo parziale, contratto di lavoro intermittente, somministrazione di lavoro, collaborazioni coordinate e continuative, lavoro occasionale), nonché del trattamento economico del lavoratore e delle principali forme di tutela nel posto di lavoro. In the special part, the course, carried out with monographic method, is designed to give students the tools necessary to understand the main regulatory structures through which the tax burden takes place and by which the compliance with law is granted, analyzing critically the different tax laws in the current tax system.

Given the reference to the fundamental notions of general theory of crime, the course aims to provide advanced knowledge of obligations and penal sanctions in the field of hygiene and safety of the workplace pursuant to Legislative Decree No 81/2008, with regard to both position of the individual subjects (employer, managers, supervisors, those in charge of prevention and protection system, qualified physician, workers' representatives for safety, workers, client or project supervisor, coordinators for the planning or execution of the works), even in the case of a contract or works in temporary or mobile construction sites, and to the amministrative liability of legal entities pursuant to Legislative Decree No 231/2001, after examining the most recent jurisprudential guidelines on the matter.
As for individual positions, the purpose is to analyze the criteria for the objective and subjective imputation of accident offenses, both contraventional and criminal, with particular regard to manslaughter and culpable personal injury, focusing on the assessment of the guarantee positions, of the casual link and guilt, also in relation to the meaning of art. 2087 of the Italian Civil Code, as well as on the conditions for cooperation in the culpable crime, in light of the validity and effectiveness requirements of the delegation of functions and the limits of the principle of expectation or of the distinctions between senior and subordinate subjects, guarantee and surveillance obligations, operational and organizational control (or "high supervision"), culpa in eligendo and culpa in vigilando. As for the collective body, having examined the imputation referred to in Legislative Decree No 231/2001, the aim is to deepen the techniques for drafting the organizational models, the criteria for assessing the relevant eligibility requirements and effective implementation in relationship to accident prevention obligations and to the various control tools (certifications, quality systems, risk assessment documents, etc.) as well as the methods of composition and functioning of the supervisory body. With the successful learning of the aforementioned notions, the course therefore aims to ensure the acquisition of the necessary tools to hold managerial positions or in any case take responsibility for safety in the company or to carry out consulting activities, assistance or even representation or defence in court against the possible contestation of accident offenses to natural or legal persons.

The course is divided into five teaching modules.

In the first, the different administrative functions and their impact on the lives of citizens and businesses are analyzed. In the second, the organizational design of the public organization is reconstructed, noting that each organizational model is marked by a different "logic of collective action." In the third module, the different manifestations of administrative action are examined, highlighting, in particular, the characters of administrative power and discretion and the areas of contractual autonomy. In the fourth module, the study of the different techniques of regulation of administrative action, both authoritative and contractual, aimed at ensuring the pursuit of the public interest and avoiding abusive behavior of the public administration to the detriment of private parties is explored. In the fifth (and final) module, the means of protection provided by the legal system for individuals who complain about the violation of their rights and interests are highlighted. The exposition of the discipline of the subject will be conducted through the collective discussion of practical cases and judgments, highlighting the legal framework, the strategies pursued by the various actors, the outcome of the judgment, its concrete consequences and the underlying general problems. The three texts for the exam are the following: the textbook, the collection of cases and the collection of selected articles on the new Public Contracts Code (only for GLS students also the comparative textbook).

INSTITUTIONS OF PRIVATE LAW

The course aims to provide a critical knowledge of the main issues and problems of private law in light of the recent reforms that have contributed to the ever-increasing proliferation of special legislation and the loss of centrality of the civil code. In this perspective, a particular look will be directed to European law, which has led to a radical renewal of the framework of sources by introducing in our system subsystems designed to support, and sometimes replace, domestic law. In this path, the teaching aims to provide 1) a thorough knowledge of the fundamental notions of private law in the Italian and European legislative framework; 2) the ability to contextualise, analyze and critically interpret sources of a different nature (European directives and regulations, our Constitutional Charter, the civil code, the principles of law enunciated by the jurisprudence of the European Court of Justice and the national court); 3) the lexical and conceptual tools necessary for the study of private law and useful for acquiring good exhibition skills in written and oral form. Expected learning outcomes:
- Analysis and in-depth analysis of the main institutions of private law with particular reference to the system of sources, the criteria of interpretation, the right of persons and family, the law of succession, real rights, the regulation of obligations and contracts in general, to typical and atypical contracts and to the civil liability system. - Acquisition of technical language and a theoretical framework suitable for depicting and ordering the subject matter. - Ability to interpret the regulatory provisions in full autonomy and to frame the concrete cases, paying particular attention to the main jurisprudential orientations and to the broader European context. - Ability to identify possible solutions in case of conflict of subjective legal situations through a critical analysis of the main jurisprudential orientations and of the most consolidated doctrinal guidelines in the light of the changed economic, social and regulatory framework. - Ability to present the acquired knowledge in the field of private relations in a complete and critical way, using an appropriate technical language. The course of Private Law Institutions is aimed at allowing students to learn the fundamental notions of private law understood as that complex of rules that govern the intersubjective relationships between the individual members in their patrimonial sphere but also personal and family. Particular attention will be paid to the right of people - physical and legal - to which the system recognizes the quality of subjects of law, that is, holders of active and passive legal situations. Family law will also be studied in depth, consisting of a set of legal rules that concern not only the traditional family based on the marriage of a heterosexual couple, but also civil unions between persons of the same sex and de facto cohabitation, recently debated reforms. The law of succession will also be addressed, whose provisions are aimed at regulating the personal and patrimonial relations of the individual after death, and the subject of real rights, that is rights over things, with particular reference to the ways of purchasing and of transfer of the right of ownership between the living, as well as the real rights of enjoyment, possession and usucation. A special look will also be given to the general regulation of obligations and the contract and to the main rules on individual contracts and other sources of obligations. The course is divided into five teaching modules.

In the first, the different administrative functions and their impact on the lives of citizens and businesses are analyzed. In the second, the organizational design of the public organization is reconstructed, noting that each organizational model is marked by a different "logic of collective action." In the third module, the different manifestations of administrative action are examined, highlighting, in particular, the characters of administrative power and discretion and the areas of contractual autonomy. In the fourth module, the study of the different techniques of regulation of administrative action, both authoritative and contractual, aimed at ensuring the pursuit of the public interest and avoiding abusive behavior of the public administration to the detriment of private parties is explored. In the fifth (and final) module, the means of protection provided by the legal system for individuals who complain about the violation of their rights and interests are highlighted. The exposition of the discipline of the subject will be conducted through the collective discussion of practical cases and judgments, highlighting the legal framework, the strategies pursued by the various actors, the outcome of the judgment, its concrete consequences and the underlying general problems. The three texts for the exam are the following: the textbook, the collection of cases and the collection of selected articles on the new Public Contracts Code (only for GLS students also the comparative textbook).

An initial reading of the textbook before the beginning of the course or, in any case, of the individual lectures is highly recommended. Only for students of Global Legal Studies the study of G. The course – which is preliminary to all other courses in public law – aims at offering the acquisition of the fundamental elements of institutional nature in the domain of public law, and provide an overview on the matters that characterise our legal system.

The relationship between security of rights and the right to security will finally be examined, against the background of constitutional law.

The general part of the course is aimed at the examination of the essential aspects of the organization of the State, the characteristics of the legality of the government, the distribution of public establishments, the sources of law, the issues connected with the involvement of Italy in the European Community and the European Union, the arrangement of national territorial autonomy. Futhermore will be given particular attention to the foundamental rights protection, in connection with the effective guaranties to provide the effectivity of the mentioned protection, public administration activities, and the origins, the models and the developement of Constitutional Justice. Special part The special part of the course is aimend at the deepening of the issues connected with security on a legal perspective, especially on the undertones and the incessant evolution of the argument. Always caring about the national and supranational view, further attention will be given to the issue of security, both as a guarantee and as a potential limit of founamental rights. The security guarantee will be examinated in respect of the form of governament, of the diffrent dimensions of territorial security and of the issues connected to information transparency, especially cybersecurity.
