The first module will provide an overview of the main authors and theories which have influenced contemporary legal culture. Particular attention will be dedicated to the differences between legal positivism and the natural law tradition. The course aims to provide a good knowledge of the main aspects of the European Union integration.

The course is divided into two parts: a general part and a special section dedicated to the EU migration and asylum law. The general part takes into account the EU basic structure and principles, with particular reference to the legal system after the Lisbon Treaty. As to the substantive law, it dedicates peculiar attention to the EU division of competences, the foreign and security policy, the police and judicial cooperation in criminal matters and the EU external relations. As to the institutional framework, the functioning of all the Institution is examined, including their relations. In addition, a sound part of the course is dedicated to the EU legal system, including the legislative procedures and the hierarchy of EU legal sources. Il programma del corso comprende il diritto sindacale, la disciplina del rapporto individuale di lavoro, il lavoro nelle pubbliche amministrazioni e la previdenza sociale. La trattazione del diritto sindacale comprende i seguenti argomenti: 1) l’organizzazione sindacale; 2) la contrattazione collettiva; 3) lo sciopero. La disciplina del rapporto individuale dì lavoro sarà introdotta da un’analisi delle fonti interne ed internazionali del diritto del lavoro. Verranno, poi, affrontati i seguenti argomenti: 1) il rapporto di lavoro subordinato: natura e connotati. Differenze rispetto al rapporto di lavoro autonomo; 2) la tipologia dei rapporti di lavoro; 3) il divieto di interposizione e d’intermediazione nelle prestazioni di lavoro; 4) l’incontro tra domanda e offerta di lavoro; 5) il contratto di lavoro: requisiti soggettivi ed oggettivi; 6) gli obblighi del prestatore di lavoro; 7) i poteri del datore di lavoro; 8) la tutela della libertà e dignità del lavoratore; 9) i diritti del lavoratore; 10) il contenuto della prestazione lavorativa; 11) l’estinzione del rapporto di lavoro; 12) la tutela dei diritti del prestatore di lavoro; 13) le vicende modificative del rapporto di lavoro con particolare riferimento al trasferimento d’azienda; 14) il lavoro nelle pubbliche amministrazioni. Per quanto attiene alla parte relativa al diritto della previdenza sociale, gli argomenti trattati riguarderanno: 1) l’evoluzione storico-giuridica della previdenza sociale nell’ordinamento italiano; 2) l’attuale sistema giuridico della previdenza sociale. Infine, il corso affronta, in una prospettiva sistematica, le innovazioni più recenti del diritto del lavoro, con particolare riguardo alle seguenti tematiche: il diritto internazionale e dell’unione europea; la riforma del mercato del lavoro; la revisione delle tutele. • G. The course will focus, at first, on the sources of Administrative Law, that is the normative acts regarding public administration institutions and key principles governing their activities.

In the first one the main topic consists in analysing the strategic relationships inside ADMINISTRATIVE LAW (AL), especially about the historical and political processes that give birth to administrative functions. In the second place, the class will shift its attention on the organization of public administration (PA), by highlighting how each structure is characterized by a different logic of collective action. In the third place, the class will discuss how the PA works, by focusing on the main public power’s features and administrative discretion (i.e. contractual freedom). From this moment on, the fourth sections will deepen the different approaches to regulation (both authoritative and contractual) in order to understand how individuals can be preserved by abuses of public power. Civil procedure attends to dynamic field of judicial experience; the one is affirming the existence of rights, the other is their effective being and peaceful practice. Whether a right is denied or its practice is forbidden, we need effective redress devices. Civil procedure attends to relationships between claimant and defendant. Before studying how proceedings are regulated, however, we need to describe the aim which they can pursue, that is protection forms, which overlap to different kinds of manageable action. We need to specify prerequisities of Courts before which the proceedings is brought, as well as qualities of parties involved in the proceedings, and devices that each of them can use. These general topics concern the first part of the course. In the second and third part we will examine rules of ordinary proceedings before lower courts and appeals.

The course of Roman law has monographic approaches and it is directed to explore the techniques of legal reasoning developed by Roman jurisprudence and their contribution in the construction of modern legal science.

To this end, the course is divided into two modules, one general and one monographic. The general module focuses on the study of the sources of Roman law, from the ancient period to the compilation of Justinian, in their dual role as sources of knowledge and sources of law. The attention will be particularly focused on the role of Roman jurisprudence, as a driver of productive law and a filter between the sources of law and practice. Specific insights you have on the methodology of interpretation of ‘creative jurisprudence’ with the analysis of the method by studying the texts of the Roman literature . The special module, focusing on the analysis of one or more ' institutions ' or ' problem areas ', will focus on the analysis of the solutions, as a kind of case law, on liability for eviction or defective performance in emptio venditio and locatio conductio which reports that becomes relevant the interdependence of bonds and parts’s bona fides. The programme has a special feature and is intended to deepen, through the reading of the sources, techniques of legal reasoning developed by Roman jurisprudence and their influence on European scientia iuris. From this point of view the analysis of specific ‘institutions’ of Roman Law assumes particular importance. Course Programme The course consists of two parts: a general part and a specific part. Frequency is recommended, given the nature of the course. General Part This part will focus on the analysis, through the reading of the sources, of the structure of production of sources of law in different historical periods of the evolution of Roman Law, particularly with regards to the activities of Jurists and to their argumentative techniques. Specific Part This part is intended to deepen, through the reading of the sources, techniques of legal reasoning developed by Roman jurisprudence particularly with regards to casistic method, to the evolution of the principle of stare decisis in Common Law, to the relation between casistic interpretatio and European scientia iuris. Prerequisites The course contents and the place it has in the first half of the fourth year of the Master of Science in Law (Class LMG/01) implies that the students have adequate institutional knowledge of the sources of Roman Law with specific attention to the activity of jurisprudence is mandatory, as well as the private procedural system. Frequency is recommended, given the nature of the course. Exam The exam consists of an oral test.
