The “General Part” is the object of the programme of Istituzioni di diritto privato I, which firstly introduces to the students the general foundations of the legal system, essential for the comprehension of what is “Law”, and how it operates in the society as a regulatory framework for interpersonal relationships. The analysis of legal sources highlights the current relevance of the European Law and of the Constitution, demonstrating that the study of private law can not be confined to the norms of the civil code. The course is then focused on the doctrinal classification of the different kinds of rights and on the discipline of subjects of law (with particular reference to individuals and personality rights). The programme also includes the complete analysis of the law of obligation and contract in general, encompassing: a) sources of obligation (unilateral promises, negotiorum gestio, undue payment, unjust enrichment); b) real guarantees (not the personal ones, that are part of the course of Istituzioni di diritto privato II); c) system of land registration (in the broader context of the circulation of rights).

(1) Introduction to private law (3 cfu) The first module of the course deals with the concept of juridical norm and with the sources of law (particular attention is given to the European level of normative production, and to the relevance of the Constitution in private-law relationships). The course then analyzes the subjects of private law, and the main categories of legal situations abstractly available to them (examining, here, prescription and forfeiture). (2) The obligation in general (2 cfu) The second module deals with the law of obligation in general. In particular, the following topics are examined: (i) the sources of obligations (with specific attention, here, on legal sources different from contracts and torts); (ii) the main types of obligations (with particular attention to pecuniary obligations); (iii) modifications of the active and passive side of the debtor-creditor relationship; (iv) the extinction of the obligation (exact fulfillment and different methods of extinction); (v) the debtor's liability (with reference to the third module, on contractual remedies). (3) The contract in general (3 cfu) The third module deals with the law of contract in general. In particular, the following topics are examined: (i) the notions of contract and of private autonomy (typical and atypical contracts; references to consumer contract); (ii) the essential and accidental elements of the contract; (iii) the conclusion of the contract (with analysis extended to pre-contractual liability and to representation); (iv) the effects of the contract (in particular: rules for interpretation and integration, and reference to the fourth module); (v) the simulation; (vi) contractual invalidities (references to consumer protection); (vii) damages for non-performance (viii) termination of the contract. (4) Protection of rights (2 cfu) Based on the concepts examined in previous modules, the fourth and final part of the course examines the following topics: (i) patrimonial liability (in relation to which the following topics are analyzed: real security rights; the judicial means of preserving patrimonial guarantee); (ii) land registration (with reference to the effects of contract in the the circulation of wealth). The course of Institutions of Private Law II is aimed at allowing students the critical deepening of some typical institutions of private law understood as that complex of rules that govern the intersubjective relationships between the individual members in their patrimonial sphere but also personal and family. Particular attention will be paid to the right of people - physical and legal - to which the system recognizes the quality of subjects of law, that is, holders of active and passive legal situations. Family law will also be studied in depth, consisting of a set of legal rules that concern not only the traditional family based on the marriage of a heterosexual couple, but also civil unions between persons of the same sex and de facto cohabitation, recently debated reforms. The law of succession will also be addressed, whose provisions are aimed at regulating the personal and patrimonial relations of the individual after death, and the subject of real rights, that is rights over things, with particular reference to the ways of purchasing and of transfer of the right of ownership between the living, as well as the real rights of enjoyment, possession and usucation. A special look will also be given to some special contracts (sale, lease, lease, sale and lease back, factoring, franchising, contract, mandate, deposit, loan, mortgage, transaction, consumer contracts) and finally to the delicate issue of civil liability, the complex of illicit facts to which a compensation obligation arises for those who have caused unfair damage.

LEGAL LOGIC AND ARGUMENTATION
The Logic and legal argumentation course is a legal philosophical subject (IUS/20) intended to provide law students with interpretative and argumentative skills required to practice any legal profession. To that end, the course’s objectives are: 1) to provide the students an introduction to basic logical concepts; 2) to enable students to master the main interpretative and argumentative techniques employed in legal reasoning; 3) to enable students to analyze complex legal arguments, such as those found in judicial decisions and to autonomously develop lines of legal reasoning. The main intended learning outcomes are: 1) knowledge and understanding: be familiar with and understand the fundamental concepts of legal logic and theory of interpretation; 2) ability to apply the acquired knowledge and understanding: to acquire the ability to use autonomously the techniques of legal reasoning; 3) autonomous assessment: to acquire the capacity to critically evaluate a legal argument, in particular those contained in the reasoning of judicial decisions; 4) Communication skills: to communicate the acquired knowledge in a full and exhaustive manner in short written papers; 5) learning skills: to be able to identify the main theoretical and logical problems underlying argumentation in general and legal argumentation in particular; to be aware of the relationship between these problems and the more general issues in legal theory (e.g. the relation between law and morality, the separation of State powers etc.)

The course is aimed to analyze and deepen the trade union law, the discipline of the individual employment relationship, employment in public administrations and public and private social security. Particular attention will be paid to the most recent regulatory reforms and their application by case-law.

First of all, general notions and sources (domestic and international) of employment law will be examined in the context of economic globalization and the crisis of the welfare state (1st teaching unit). Then the study of trade union law will be addressed, including the following topics: historical evolution and sources; trade union organisation; collective bargaining; problems of trade union representation; strike, including in essential public services (2nd unit). Subsequently, the discipline of the contract and the employment relationship will be examined in greater depth, and in particular the following topics: the labour market; the subordinate employment relationship, its nature and connotations, differences with respect to the self-employment relationship; the types of employment relationships and contractual models; the matching of labour supply and demand; the employment contract, subjective and objective requirements; the obligations of the employer; the powers of the employer; the protection of the freedom and dignity of the employee; the rights of the worker and in particular the rights of the person and remuneration; the content of the employment performance; the termination of the employment relationship and in particular individual and collective dismissals; the protection of the rights of the employee; changes in the employment relationship, with particular reference to the transfer of the company; employment in public administrations (3rd unit). In the first one the main topic consists in analyzing the strategic relationships inside administrative law (AL), especially about the historical and political processes that give birth to administrative functions.

Civil procedure attends to dynamic field of judicial experience; the one is affirming the existence of rights, the other is their effective being and peaceful practice. Whether a right is denied or its practice is forbidden, we need effective redress devices. Civil procedure attends to relationships between claimant and defendant. Before studying how proceedings are regulated, however, we need to describe the aim which they can pursue, that is protection forms, which overlap to different kinds of manageable action. The course is aimed at providing the students, through a monographic study of the juridical phenomenon about the divergence between the wanted crime and the realized one, with instruments for a dogmatic and criminal-politic analysis, in an advanced and specialized way, of some of the main institutes of the general theory of crime, such as intention, negligence, unintention, mistake in fact – in particular, as to the specializing elements -, the so-called “aberratio”, the fortuitous event and the force majeure as general limits to the “personal” criminal liability. The course of Roman law has monographic approaches and it is directed to explore the techniques of legal reasoning developed by Roman jurisprudence and their contribution in the construction of modern legal science.

To this end, the course is divided into two modules, one general and one monographic. The general module focuses on the study of the sources of Roman law, from the ancient period to the compilation of Justinian, in their dual role as sources of knowledge and sources of law. The attention will be particularly focused on the role of Roman jurisprudence, as a driver of productive law and a filter between the sources of law and practice. Specific insights you have on the methodology of interpretation of ‘creative jurisprudence’ with the analysis of the method by studying the texts of the Roman literature . The special module, focusing on the analysis of one or more ' institutions ' or ' problem areas ', will focus on the analysis of the solutions, as a kind of case law, on law of obligations. The content of the course is an in-depth study of the following topics:

"International community" relevant from a legal point of view; - the international subjectivity of States and other recipients of the rules of international law (in particular, international organizations); changes of sovereignty and "identity" of the State in international law. - the system of sources: customs and general international law, treaties and the law of the treaties, the sources foreseen by agreement, the relations between written law and unwritten law, the process of codification of international law, the so-called non-binding rules; - the relationships between international law and domestic legal orders and the adaptation of the Italian legal system to international rules; - wrongful facts in international law and the international responsibility of States and international organizations; - international dispute settlement and international jurisdictions. In summary, family law and the regulation of inheritances and donations will be examined, while only some of the typical contracts regulated by the Civil Code will be considered. The student will learn the basic development of law from the late antiquity to the 20th Century. The course will connect basic historical learning with specific legal-historical questioning, focussing mainly on the moments of crisis or renovation which determined the principal features of Western legal systems.

The main aim of the course is to grasp some general narratives of the history of legal practice and legal doctrines over a very long period. The knowledge of historical sources and historical contexts is necessary to build those general narratives. The course will deal with legislations and their political frameworks, some legal literature and some main figures of legal authors. On the base of these sources, some aspects of the legal institutions which were adopted in different historical periods will be presented.

Il programma del corso comprende il diritto sindacale, la disciplina del rapporto individuale di lavoro, il lavoro nelle pubbliche amministrazioni e la previdenza sociale. La trattazione del diritto sindacale comprende i seguenti argomenti: 1) l’organizzazione sindacale; 2) la contrattazione collettiva; 3) lo sciopero. La disciplina del rapporto individuale dì lavoro sarà introdotta da un’analisi delle fonti interne ed internazionali del diritto del lavoro. Verranno, poi, affrontati i seguenti argomenti: 1) il rapporto di lavoro subordinato: natura e connotati. Differenze rispetto al rapporto di lavoro autonomo; 2) la tipologia dei rapporti di lavoro; 3) il divieto di interposizione e d’intermediazione nelle prestazioni di lavoro; 4) l’incontro tra domanda e offerta di lavoro; 5) il contratto di lavoro: requisiti soggettivi ed oggettivi; 6) gli obblighi del prestatore di lavoro; 7) i poteri del datore di lavoro; 8) la tutela della libertà e dignità del lavoratore; 9) i diritti del lavoratore; 10) il contenuto della prestazione lavorativa; 11) l’estinzione del rapporto di lavoro; 12) la tutela dei diritti del prestatore di lavoro; 13) le vicende modificative del rapporto di lavoro con particolare riferimento al trasferimento d’azienda; 14) il lavoro nelle pubbliche amministrazioni. The course aims at providing an understanding of the process of Europeanization of private law. After a basic introduction on the institutional framework of EU law, necessary to understand its interplay with the purposes and methods of private law harmonization, the course focuses on EU Primary Sources (in particular, EU fundamental rights and freedoms, and their horizontal effects in private law matters) and EU Secondary Sources (with focus on legislative and judiciary techniques of unification and harmonization of the law). Attention is given also to the role of the European Court of Justice in the edification of EU private law and to the results of non-legislative projects of harmonization promoted at European level. The core areas of EU private law are then surveyed (contract law, with specific focus on consumer contracts; tort law, with specific focus on product liability regimes; basic issues of EU data protection law, and hints to European family and property law).
