21810236 - SEMINAR - BIOLAW AND CONSTITUTION (objectives) With the beginning of the new millennium, the hot topics of public law were related to the cycle of human life (life beginning, reproductive choices, end of life, mandatory vaccinations, etc.), but today they are also opening up to the critical issues emerging from the development of Artificial Intelligence. The public health emergency of Covid-19 has further placed bio-juridical choices at the center of (our or everyone) attention. It is for the broadening of all these new themes that the question on the relationship between science, technology and law (bio-law, more precisely) assumes relevant importance. The seminar activity will mainly have a casuistic and practical cut and - despite being open to all the students - constitutes an ideal corollary of the attendance to the Biolaw course. 21810321 - SEMINAR - THE ROLE OF SUBNATIONAL GOVERNMENTS IN A GLOBAL PERSPECTIVE: THE CHALLENGE OF FOOD SECURITY (objectives) The seminar aims to analyze some emerging food safety initiatives at the local level. The global crisis triggered by Covid-19 enters into a double relationship with the concept of food security. The origin of this virus seems to be linked to how agri-food production takes place. The emphasis is on intensive farming, deforestation, erosion and contamination of soils and natural resources, hunting and trading in wild animals; but also on the hygienic-sanitary conditions linked to the production process and how food is processed (i.e. "wet markets" case ). Covid-19, for instance, appears to arise from weak and unsustainable food systems and appears to have imposed a forced slowdown on an overheating society (Eriksen, 2017). At the same time, the spread of the virus had a boomerang effect on the food system that somehow generated it. The measures put in place to limit their transmission have had an impact on the food system: failure to supply some goods; price increase; increase in the number of people who, no longer receiving a salary, or receiving it in a reduced form, do not enjoy safe and guaranteed access to goods on the market. The instability of the food system has, therefore, translated into social instability. In a moment of global emergency, the crucial role of public policies for a social safety net, but also of bonds of solidarity, is increasingly evident (Fraser, 1989; Tiryakian, 2009). We are witnessing the flourishing of civil society initiatives that not only highlights the different unfolding of social inequalities but also offer alternatives to address them (Burawoy, 2015) through a new notion of solidarity. - AUTERI MONICA	1	-	-	-	-	Other activities	ITA
21810314 - SEMINAR - INTERCULTURAL DIPLOMACY (objectives) Intercultural diplomacy is a new way of analizing international relations dynamics, from a synthetic and inclusive perspective. In general terms diplomacy embodies the richest part of the possibilities offered by international relations (public and private) through dialogue, kind assertiveness, and truthfulness. It means identifying potential syntheses between different cultures and working together with the aim of rediscovering oneself in the Other, living purposefully in the Other, accepting oneself and accepting the Other more fully. So far intercultural diplomacy requires an area of action ranging from politics to trade, development cooperation, culture, communication, solidarity, and creativity of law. But more than anything else, there is a need to develop a permanent, natural, fluid, intercultural attitude that tends to avoid (or at least suspend) judgment, and pushes us to better understand the surrounding reality, by savouring and metabolizing it to a greater extent. Deepening some of the functions of the human psyche that belong to every person's world of behavioural responsiveness (such as understanding, knowledge, vision, organization, experimentation, determination, synthesis) can greatly help to achieve these goals, allowing us to appreciate everyday life as a continual and fertile discovery of what is new. The main scope of the Course is gifting students with theoretical, practical and experiential tools so as to face international job sphere duly equipped in terms of best management of diversity in all areas of diplomacy. After an initial part dedicated to national issues in the Tsarist and Soviet era, the course focuses on the cases of conflicts and de facto entities in Nagorno-Karabakh, Transnistria, Abkhazia and South Ossetia. 21810318 - SEMINAR - THE ITALIAN OCCUPATION IN THE BALKANS 1941-1943 (objectives) In the seminar the Italian military occupations in the Balkans will be analysed in the light of the advances in Italian historiography. Some of the monographs of the last twenty years will be compared with the classics of international historiography. Within the new Mediterranean order of Fascism, the military experiences in the Balkans present "economic characteristics" useful for a comparison with other European realities. Particular attention will be paid to the study of the jurisprudential elaboration of the common principles of administrative action, which represent one of the main vehicles of the gradual rapprochement between national administrative traditions. The methodology provides for the active participation of students, who will be involved in the research and discussion of different case laws, with the aim of learning to trace the orientation outlined in the jurisprudential decisions and understand its meaning in relation to the reference topic. The teaching materials, therefore, will consist of jurisprudential and normative sources and doctrinal comments. From a historical point of view, the main educational aim is to underline the relation of what has happened in Chinese political thought and institutions during the last few decades to the new role role that this country is going to play in the international system. In this context, it is becoming increasingly important to provide university students with the fundamental tools to develop their skills in the field of online communication. The seminar aims at illustrating the different actions that can produce an effective communication strategy, such as: positioning on search engines, dissemination of content on social media, digital pr and monitoring of results. In the second part of the seminar, these theories will be analyzed within a specific case study involving how the institutions communicate their decisions to the local community (citizens, businesses) about innovative measures concerning the transport and logistics sector, with particular reference to the PUMS (Sustainable Urban Mobility Plans). The course aims to provide useful tools to understand the phenomenon of deviance, crime and punishment in Western societies through the most important theories of international and Italian legal-criminal sociology, as well as the relationship between law and Gender studies.
In the first module, we will work on the Liberal School of Criminal law, on the ideology of social defence, on psychoanalytic theories of crime, on deviance and regulatory voids, on the "labelling approach", on the sociology of conflicts in reference to the criminal phenomena, the political corruption and the crime of the "white collars", on the prison and the social marginality, on the prospect of the school of Critical criminology.
The second module will offer more specific tools, i.e. the analysis of the symbolic, cultural and legal function of the contribution of feminist studies in relation to law, deviance and power. In particular, the relationship between the Thought of Sexual Difference and the doctrine of Juridical Experience will be investigated, both at a theoretical level and in the practices carried out in trials, as well as the concept of “Juridical Feminism” applied to the main themes of the present time: equality/difference; citizenship/borders; criminology/delinquency/security; justice/law/rights; gender/sexuality/reproduction; victim/victimology/vulnerability.

21801873 - ECONOMIC ANALYSIS OF THE LAW (objectives) In the first part of the seminar we’ll discuss basic elements of economic analysis of public law, known as public choice theory. In our first meeting we’ll identify two distinct public choice theories—“a public interest” approach (aka Madisonianism or “republicanism”) vs. “public of interests” view (aka “pluralism”). Under the former, decision-makers should base their decisions on “public reason” (in the Rawlsian sense) rather than on self-interest. The aim of public law is to ensure that decision-making is based on impartial considerations. In contrast, the competing theory reflects a welfarist approach, under which the desired social decisions are those that maximize some social welfare function. In general, it endorses a decentralized approach, in which the social decision is achieved by aggregating the relevant persons’ interests and preferences. Accordingly, the aim of public law under this view is to ensure that decisions accurately aggregate the various interests of those affected. We will discuss the central normative and behavioral aspects of each of these theories. The investigation, in its general part, has as its object the activity of common law of the Public Administration, analyzing institutions and relationships in which the public administrations operate as subjects of common law: from private organizational forms, to the ownership of dominical rights, to the stipulation, instead of issuing administrative measures, negotiation with private parties, and finally civil liability for the injury of subjective legal situations pertaining to individuals. The course offers an interpretative-methodological framework to the transport-territory economic relationship, based on the assumption that the transport system is a pre-requisite for the development of industrial and tourist activities. 21810321 - SEMINAR - THE ROLE OF SUBNATIONAL GOVERNMENTS IN A GLOBAL PERSPECTIVE: THE CHALLENGE OF FOOD SECURITY (objectives) The seminar aims to analyze some emerging food safety initiatives at the local level. The global crisis triggered by Covid-19 enters into a double relationship with the concept of food security. The origin of this virus seems to be linked to how agri-food production takes place. The emphasis is on intensive farming, deforestation, erosion and contamination of soils and natural resources, hunting and trading in wild animals; but also on the hygienic-sanitary conditions linked to the production process and how food is processed (i.e. "wet markets" case ). Covid-19, for instance, appears to arise from weak and unsustainable food systems and appears to have imposed a forced slowdown on an overheating society (Eriksen, 2017). At the same time, the spread of the virus had a boomerang effect on the food system that somehow generated it. The measures put in place to limit their transmission have had an impact on the food system: failure to supply some goods; price increase; increase in the number of people who, no longer receiving a salary, or receiving it in a reduced form, do not enjoy safe and guaranteed access to goods on the market. The instability of the food system has, therefore, translated into social instability. In a moment of global emergency, the crucial role of public policies for a social safety net, but also of bonds of solidarity, is increasingly evident (Fraser, 1989; Tiryakian, 2009). In general terms diplomacy embodies the richest part of the possibilities offered by international relations (public and private) through dialogue, kind assertiveness, and truthfulness. It means identifying potential syntheses between different cultures and working together with the aim of rediscovering oneself in the Other, living purposefully in the Other, accepting oneself and accepting the Other more fully. So far intercultural diplomacy requires an area of action ranging from politics to trade, development cooperation, culture, communication, solidarity, and creativity of law. But more than anything else, there is a need to develop a permanent, natural, fluid, intercultural attitude that tends to avoid (or at least suspend) judgment, and pushes us to better understand the surrounding reality, by savouring and metabolizing it to a greater extent. Deepening some of the functions of the human psyche that belong to every person's world of behavioural responsiveness (such as understanding, knowledge, vision, organization, experimentation, determination, synthesis) can greatly help to achieve these goals, allowing us to appreciate everyday life as a continual and fertile discovery of what is new. The main scope of the Course is gifting students with theoretical, practical and experiential tools so as to face international job sphere duly equipped in terms of best management of diversity in all areas of diplomacy. Class discussion will follow each presentation. At the end of the course, attending students will be required to write a 4000 word paper, analyzing the book chosen in the light of the analyses and discussions from the seminar. Only for students attending the course, the assessment related to the first part of the course may take the form of a mid-term written exam, to be taken during the course (esonero). It will provide the tools needed to understand the rising problems, the innovative apparatuses linked to visual arts, critical thought, and gender studies, together with the classic themes of the socio-legal thought. - SIMONE ANNA (syllabus) The course aims to provide useful tools to understand the phenomenon of deviance, crime and punishment in Western societies through the most important theories of international and Italian legal-criminal sociology, as well as the relationship between law and Gender studies. In the first module, we will work on the Liberal School of Criminal law, on the ideology of social defence, on psychoanalytic theories of crime, on deviance and regulatory voids, on the "labelling approach", on the sociology of conflicts in reference to the criminal phenomena, the political corruption and the crime of the "white collars", on the prison and the social marginality, on the prospect of the school of Critical criminology. The second module will offer more specific tools, i.e. the analysis of the symbolic, cultural and legal function of the contribution of feminist studies in relation to law, deviance and power. In particular, the relationship between the Thought of Sexual Difference and the doctrine of Juridical Experience will be investigated, both at a theoretical level and in the practices carried out in trials, as well as the concept of “Juridical Feminism” applied to the main themes of the present time: equality/difference; citizenship/borders; criminology/delinquency/security; justice/law/rights; gender/sexuality/reproduction; victim/victimology/vulnerability. 21801873 - ECONOMIC ANALYSIS OF THE LAW (objectives) In the first part of the seminar we’ll discuss basic elements of economic analysis of public law, known as public choice theory. In our first meeting we’ll identify two distinct public choice theories—“a public interest” approach (aka Madisonianism or “republicanism”) vs. “public of interests” view (aka “pluralism”). Under the former, decision-makers should base their decisions on “public reason” (in the Rawlsian sense) rather than on self-interest. The aim of public law is to ensure that decision-making is based on impartial considerations. In contrast, the competing theory reflects a welfarist approach, under which the desired social decisions are those that maximize some social welfare function. In general, it endorses a decentralized approach, in which the social decision is achieved by aggregating the relevant persons’ interests and preferences. Accordingly, the aim of public law under this view is to ensure that decisions accurately aggregate the various interests of those affected. We will discuss the central normative and behavioral aspects of each of these theories.
