The first module will provide an overview of the main authors and theories which have influenced contemporary legal culture. Particular attention will be dedicated to the differences between legal positivism and the natural law tradition. Primo modulo: Il positivismo giuridico dall'800 all'epoca contemporanea. Secondo modulo: Diritti umani e biotecnologie. Il primo modulo affronta il problema del contenuto e del significato dell'esperienza continentale con riferimento al giusnaturalismo, allo storicismo, al realismo giuridico. Viene altresì esaminato lo sviluppo del common law con particolare riferimento al '600. Autori di riferimento: Coke, Hobbes, Portalis, Bentham, Austin, Savigny, Jhering, Kelsen, ecc. Il secondo modulo tratta la tutela dei diritti umani e fondamentali con particolare attenzione allo sviluppo delle biotecnologie e delle tecniche nel campo dell'ingegneria genetica e della procreatica. This course has to provide the basic knowledge of Roman private law and civil proce-dure, with coverage of all key topics, including the Roman systems of the sources of law and the role of the jurists. The study of Roman law is always connected on the one side to the broader social, po-litical and economic Roman context, on the other side to modern legal systems. The topics are: General traits of the different ages of Roman law. Sources of Roman law. Legal theory and history of law. Civil procedure. Law of persons and family. Law of property and possession. Law of obligations. Law of succession. The Roman jurists and their methods. Teaching and Learning Activities The course’s structure is mainly composed of lectures on the topics; the lectures are in a diachronic perspective, through the reasoned proposal of a periodisation that allows the awareness of highlight significant moments and stages (ancient period; preclassic and classic; the late Empire; Justinian). The “General Part” is the object of the programme of Istituzioni di diritto privato I, which firstly introduces to the students the general foundations of the legal system, essential for the comprehension of what is “Law”, and how it operates in the society as a regulatory framework for interpersonal relationships. The analysis of legal sources highlights the current relevance of the European Law and of the Constitution, demonstrating that the study of private law can not be confined to the norms of the civil code. The course is then focused on the doctrinal classification of the different kinds of rights and on the discipline of subjects of law (with particular reference to individuals and personality rights). The programme also includes the complete analysis of the law of obligation and contract in general, encompassing: a) sources of obligation (unilateral promises, negotiorum gestio, undue payment, unjust enrichment); b) real guarantees (not the personal ones, that are part of the course of Istituzioni di diritto privato II); c) system of land registration (in the broader context of the circulation of rights).

The course aims to provide a good knowledge of the main aspects of the European Union integration.

The course is divided into two parts: a general part and a special section dedicated to the EU migration and asylum law. The general part takes into account the EU basic structure and principles, with particular reference to the legal system after the Lisbon Treaty. As to the substantive law, it dedicates peculiar attention to the EU division of competences, the foreign and security policy, the police and judicial cooperation in criminal matters and the EU external relations. As to the institutional framework, the functioning of all the Institution is examined, including their relations. In addition, a sound part of the course is dedicated to the EU legal system, including the legislative procedures and the hierarchy of EU legal sources. Il programma del corso comprende il diritto sindacale, la disciplina del rapporto individuale di lavoro, il lavoro nelle pubbliche amministrazioni e la previdenza sociale. La trattazione del diritto sindacale comprende i seguenti argomenti:

1) l’organizzazione sindacale; 2) la contrattazione collettiva; 3) lo sciopero. La disciplina del rapporto individuale dì lavoro sarà introdotta da un’analisi delle fonti interne ed internazionali del diritto del lavoro. Verranno, poi, affrontati i seguenti argomenti: 1) il rapporto di lavoro subordinato: natura e connotati. Differenze rispetto al rapporto di lavoro autonomo; 2) la tipologia dei rapporti di lavoro; 3) il divieto di interposizione e d’intermediazione nelle prestazioni di lavoro; 4) l’incontro tra domanda e offerta di lavoro; 5) il contratto di lavoro: requisiti soggettivi ed oggettivi; 6) gli obblighi del prestatore di lavoro; 7) i poteri del datore di lavoro; 8) la tutela della libertà e dignità del lavoratore; 9) i diritti del lavoratore; 10) il contenuto della prestazione lavorativa; 11) l’estinzione del rapporto di lavoro; 12) la tutela dei diritti del prestatore di lavoro; 13) le vicende modificative del rapporto di lavoro con particolare riferimento al trasferimento d’azienda; 14) il lavoro nelle pubbliche amministrazioni. Per quanto attiene alla parte relativa al diritto della previdenza sociale, gli argomenti trattati riguarderanno: 1) l’evoluzione storico-giuridica della previdenza sociale nell’ordinamento italiano; 2) l’attuale sistema giuridico della previdenza sociale. Infine, il corso affronta, in una prospettiva sistematica, le innovazioni più recenti del diritto del lavoro, con particolare riguardo alle seguenti tematiche: il diritto internazionale e dell’unione europea; la riforma del mercato del lavoro; la revisione delle tutele. The course is aimed at providing the students with the fundamental and basic concepts of the so-called General Part of Criminal Law, that is the branch of legal dogmatic whose object is, mainly, the study of the sources and the limits of validity of the criminal rule, the structure of the criminal fact, the forms of manifestation of offence and the system of penalties, criminal and not, consequent to the commission of a crime. This study finds its own proofing test in the analysis of some of the most important hypothesis of the so-called “natural” offences, such as crimes against life and personal safety and crimes against property.

TAX LAW
(objectives)
The course in tax law aims to provide students with the theoretical basics for the approach to the study of the tax legal framework and to allow the deepening of the legal structure of the tax system. The course is divided into a general and a special part. The general part focuses on the study of the general principles of tax law, through the analysis of both its structure and implementation, and examining the relevant violations and tax litigation remedies. In the special part, the course, carried out with monographic method, is designed to give students the tools necessary to understand the main regulatory structures through which the tax burden takes place and by which the compliance with law is granted, analyzing critically the different tax laws in the current tax system.

The course will focus, at first, on the sources of Administrative Law, that is the normative acts regarding public administration institutions and key principles governing their activities.

Second, we will analyze the organizational structure of public administration institutions, with particular regards to its territory organization, the juridical subjects of which it is composed, and the operational, human and financial resources used. More, we will analyze in detail authoritative activities of public administrations - highlighting the administrative proceeding process, the administrative act process and related pathologies – and consensual activities as well. The course will then focus on the subjective legal rights of individual citizens facing public administration and the related form of protection. Finally, the course will treat the relationship between public power and different market actors, such as regulators, private and public networks, public services operators, infrastructures and establishments of public demand. The course will be based on five different sections.

In the first one the main topic consists in analysing the strategic relationships inside ADMINISTRATIVE LAW (AL), especially about the historical and political processes that give birth to administrative functions. In the second place, the class will shift its attention on the organization of public administration (PA), by highlighting how each structure is characterized by a different logic of collective action. In the third place, the class will discuss how the PA works, by focusing on the main public power’s features and administrative discretion (i.e. contractual freedom). From this moment on, the fourth sections will deepen the different approaches to regulation (both authoritative and contractual) in order to understand how individuals can be preserved by abuses of public power. Therefore, the last sections will be dedicated to the study of the safeguards set up by law for those who complain about the violation of their rights and interests. CIVIL PROCEDURE I

Civil procedure attends to dynamic field of judicial experience; the one is affirming the existence of rights, the other is their effective being and peaceful practice. Whether a right is denied or its practice is forbidden, we need effective redress devices. Civil procedure attends to relationships between claimant and defendant. Before studying how proceedings are regulated, however, we need to describe the aim which they can pursue, that is protection forms, which overlap to different kinds of manageable action. We need to specify prerequisities of Courts before which the proceedings is brought, as well as qualities of parties involved in the proceedings, and devices that each of them can use. These general topics concern the first part of the course. In the second and third part we will examine rules of ordinary proceedings before lower courts and appeals.

The course of Roman law has monographic approaches and it is directed to explore the techniques of legal reasoning developed by Roman jurisprudence and their contribution in the construction of modern legal science.

To this end, the course is divided into two modules, one general and one monographic. The general module focuses on the study of the sources of Roman law, from the ancient period to the compilation of Justinian, in their dual role as sources of knowledge and sources of law. The attention will be particularly focused on the role of Roman jurisprudence, as a driver of productive law and a filter between the sources of law and practice. Specific insights you have on the methodology of interpretation of ‘creative jurisprudence’ with the analysis of the method by studying the texts of the Roman literature . The special module, focusing on the analysis of one or more ' institutions ' or ' problem areas ', will focus on the analysis of the solutions, as a kind of case law, on liability for eviction or defective performance in emptio venditio and locatio conductio which reports that becomes relevant the interdependence of bonds and parts’s bona fides. The programme has a special feature and is intended to deepen, through the reading of the sources, techniques of legal reasoning developed by Roman jurisprudence and their influence on European scientia iuris. From this point of view the analysis of specific ‘institutions’ of Roman Law assumes particular importance. Course Programme The couse consists of two parts: a general part and a specific part. Frequency is recommended, given the nature of the course. General Part This part will focus on the analysis, through the reading of the sources, of the structure of production of sources of law in different historical periods of the evolution of Roman Law, particularly with regards to the activities of Jurists and to their argumentative techniques, with particular attention to casistic method, ‘analogia’ and ‘aequitas’ . Specific Part This part is intended to deepen, through the reading of the sources, techniques of legal reasoning developed by Roman jurisprudence in the fields of Roman Law of property, with specific attention to the concepts of ‘possessio’ and ‘tempus’ and their influence on the purchase of property. The following ‘institutions’ will be deepened: dominium, actio Publiciana, possessio, traditio, derelictio, usucapio, longi temporis praescriptio, ius in provinciali solo. Prerequisites The course contents and the place it has in the first half of the fourth year of the Master of Science in Law (Class LMG/01) implies that the students have adequate institutional knowledge of the sources of Roman Law with specific attention to the activity of jurisprudence is mandatory, as well as the private procedural system and the structure of Roman Law of property and of real rights. SEMINARS From the beginning of November seminars will be organized for the students of the course on the following topics: - the international protection of foreign investments and the instruments for the settlement of investor-State disputes - the international protection of indigenous peoples - the case law of the European Court of Human Rights in the field of State immunity FINAL ASSESSMENT The final assessment will take place in oral form according to a calendar that will be established well in advance.
