21801469 - HISTORY OF PUBLIC LAW (objectives) The course is intended to illustrate, through the direct examination of the sources of law and doctrine of the legal science in modern and contemporary Europe, the rationale of the constitutionalism in its legislative development during XVIII and XIX centuries with particular reference to France, Germany and Italy. Particular attention will be dedicated to the evolution of English constitutionalism, which deals with different theoretical and practical profiles with respect to those relating to French, German and Italian constitution experiences. 21201422 - INTERNATIONAL ECONOMIC LAW (objectives) The course aims to provide the foundations of International Economic Law, integrated with notions of finance law, particularly important today to understand economic flows. An introduction to international law follows a second part focusing on economic institutions (World Bank, International Monetary Fund, World Trade Organization, etc.) and a third part on the settlement of disputes. International finance law is investigated starting from sovereign wealth funds and other long, medium and short-term investment funds. 20110046 - Diritto Penale Europeo (objectives) The course "European Criminal Law" aims to examine the progressive influence on the national criminal law by European law, that include the EU law and the ECHR system. Until a few decades ago the combination of "European law" and "criminal law" appeared almost an oxymoron. The system of sources of law is conversely today more complex and labyrinthine and, at least in some respects, it is gradually changing the face of criminal law, that seemed like the more solid articulation of national sovereignty. The lessons will be developed following the main theme of the principle of legality in criminal law, in its articulations of the legislature's exclusive power to create crimes, the principle of determinacy and the principle of non retroactivity of criminal law (supplemented by that of the retroactivity of more favorable law): the objective it is to examine the metafomorphosis of the criminal legality, especially as a result of European jurisprudence. The course will also try to focus on the significant changing of the Italian system of sanctions as a result of the europeanisation of criminal law, on the side of the "double track" between criminal penalties and security measures and on the side of the compresence of criminal and administrative sanctions. In particular, it is aimed towards students being able to: i) demonstrate knowledge of EU competition law, taking a critical look at competition policy and its development; ii) deal with the primary sources of EU competition law (legislation, Commission decisions, CJEU/GC rulings); iii) carry out a presentation and a discussion on a competition law topic; iv) simulate a dispute (moot court). 20110048 - Protezione dei dati personali e tutela dei diritti fondamentali-Clinica legale privacy (objectives) The Course will be scheduled as follows: 1) Protection of fundamental rights and protection of personal data: lectures about fundamental rights, in the national and European constitutional framework, with particular regard to the evolution of the right to privacy and protection of personal data. The teacher will guide students in reading and examinating the case-law, with reference to the Constitutional Court, the Court of Justice of the European Union and the European Court of Human Rights. 2) Focus on the Privacy Code and the new European regulation: lectures and seminars related to the legislation on protection of personal data, from a theoretical perspective: - Legislative Decree no. 196/2003: the general principles of the Privacy Code; definition of controller, processor, recipient; transparent information and consent; data subjects' rights; the processing of personal data in the public and private sectors; duties and functions of the Data Protection Authority . - Regulation on data protection (EU Regulation 2016/679): the approval process; material and territorial scope ; the general principles of processing personal data; protections for special categories of personal data; Relations between data protection authorities and consistency mechanism; principle of accountability (privacy by design and privacy by default, privacy impact assessment, the figure of the data protection officer. 3) Focus on Data Protection Authority: analysis of decision-making and advice of the Data Protection Authority in the most important areas; explanation of the main measures taken by the Authority to introduce safeguards and security measures, including the penalties imposed, in the following areas: - Public and private health: electronic medical record and medical dossier, authorization on genetic data; - Internet and electronic communication: spam and the profiling systems; - Public administration: transparency in the light of the new FOIA; - Journalism: guarantees for free expression including the relationship with the institutional communication. 4) Law Clinic: advice on legal issues related to data protection to the administration of the University	7	IUS/09	56	-	-	-	Related or supplementary learning activities	ITA
20110052 - Economia, etica e mercati (objectives) In these last decades, the market has increasingly become a normative paradigm also for law (administrative law, environmental law, labor law, international law…). The main reasons lie in the alleged capacity of the market to promote not only efficiency, but also justice. With regard to this last claim, the values most often invoked include freedom, responsibility and merit. The main objective of the course is to present these reasons to the students as well as the main objections that can be addressed to them. The underlying assumption is that too often the positions and proposals about the role of markets in society, be they of praise or blame, reflect ideological biases. 20110070 - Diritto Internazionale ed Europeo dei disastri (objectives) INTERNATIONAL AND EUROPEAN DISASTER LAW The course on "International and European Disaster Law" is supported by the EU Commission in the framework of the "Jean Monnet, Erasmus+" Programme. It aims to foster knowledge on the international and European legal framework concerning response and prevention to disasters in light of the increasing relevance of such issues for main stakeholders (International organizations, NGO, Red Cross Movement, private actors) involved in activities aimed to support affected individuals and communities. It discusses the essential topics of the law of international organisations, including powers, privileges and immunities, as well as membership rules, institutional structures, and accountability. There is a focus on the United Nations system, as the paradigmatic IGO, including the activities of the specialised agencies based in Rome. Special emphasis is placed on the interaction between universalism and regionalism. The second part will provide students with basic knowledge of the rules governing banking supervision and the management of banking crisis. Special attention will be given to the area where the EU integration process is at more advanced stage: the Banking Union, namely the Single Supervisory Mechanism (SSM) and the Single Resolution Mechanism (SRM). 20110140 - WELFARE DIRITTI SOCIALI E TERRITORIO(CLINICA LEGALE) (objectives) The course aims to provide the students with knowledge and skills that will enable them to know how to frame the organization of public authorities (even in their territorial dimension), the Italian Welfare State system and the constitutional framework of social rights. Furthermore, the teaching purpose is to offer students a reflection on the nowadays condition of people with disabilities, particularly with regard to the detailed study of the disabled people’s constitutional rights and how to effectively protect them. This purpose will be achieved also through the activation of a special Information Desk for students with disabilities, in which the students will be actively involved. By the study of “Welfare, Social Rights and Territory” the student will be able to achieve the following training objectives. Knowledge and understanding: - know how public authorities are organized, including in their territorial dimension; - know models, tools and strategies to realize a Welfare State system; - know the social rights provided for in the Constitution, with particular regard to the rights of disabled people and to the institutional apparatus engaged in guaranteeing their effectiveness; - develop a reflective and project-based attitude towards the current the current implementation of social rights and the rights of disabled people. Applying knowledge and understanding: - plan and organize activities aimed at the effective implementation of social interventions; - apply technical, communicative and relational skills for the realization of activities on the territory, such as the Information Desk for students with disabilities. Making judgements: - develop the capacity to understand and evaluate the organization and activities of the institutional apparatus in particular those which guarantee social rights; - develop a critical and reflexive capacity regarding their own methods of intervention, taking into account the users with whom they deal. 20110046 - Diritto Penale Europeo (objectives) The course "European Criminal Law" aims to examine the progressive influence on the national criminal law by European law, that include the EU law and the ECHR system. Until a few decades ago the combination of "European law" and "criminal law" appeared almost an oxymoron. The system of sources of law is conversely today more complex and labyrinthine and, at least in some respects, it is gradually changing the face of criminal law, that seemed like the more solid articulation of national sovereignty. The lessons will be developed following the main theme of the principle of legality in criminal law, in its articulations of the legislature's exclusive power to create crimes, the principle of determinacy and the principle of non retroactivity of criminal law (supplemented by that of the retroactivity of more favorable law): the objective it is to examine the metafomorphosis of the criminal legality, especially as a result of European jurisprudence. The course will also try to focus on the significant changing of the Italian system of sanctions as a result of the europeanisation of criminal law, on the side of the "double track" between criminal penalties and security measures and on the side of the compresence of criminal and administrative sanctions. The structural, organizational and functional aspects of the judicial activity will also be explored. Special emphasis is placed on the analysis of the legislation on the judicial system, from its origins to its latest developments; on the structure of the judicial function, struggling between the unity enshrined in our Constitution and the judicial pluralism fostered by legislative measures enhancing the “exclusive jurisdiction” exercised by administrative courts. Starting from a description of the social, political and economic context, the legal institutions will be analyzed in their historical dimension, focusing the attention on legislation, on jurisprudence, and on the effects they had on case law. 20101107 - CIVIL PROCEDURE I (objectives) Civil procedure attends to dynamic field of judicial experience; the one is affirming the existence of rights, the other is their effective being and peaceful practice. Whether a right is denied or its practice is forbidden, we need effective redress devices. Civil procedure attends to relationships between claimant and defendant. Before studying how proceedings are regulated, however, we need to describe the aim which they can pursue, that is protection forms, which overlap to different kinds of manageable action. We need to specify prerequisities of Courts before which the proceedings is brought, as well as qualities of parties involved in the proceedings, and devices that each of them can use. These general topics concern the first part of the course. In the second and third part we will examine rules of ordinary proceedings before lower courts.
