INSTITUTES OF PRIVATE LAW I
(objectives)
Syllabus
Introduction to Law (legal sources and norms) Classes of rights Subjects of law: individuals and legal entities Obligations and Contracts Prescription and forfeiture Istituzioni di diritto privato is a unitary course, articulated into two part: a general one and a special one. The “General Part” is the object of the programme of Istituzioni di diritto privato I, which firstly introduces to the students the general foundations of the legal system, essential for the comprehension of what is “Law”, and how it operates in the society as a regulatory framework for interpersonal relationships. The analysis of legal sources highlights the current relevance of the European Law and of the Constitution, demonstrating that the study of private law can not be confined to the norms of the civil code. The course is then focused on the doctrinal classification of the different kinds of rights and on the discipline of subjects of law (with particular reference to individuals and personality rights). The programme also includes the complete analysis of the law of obligation and contract in general, encompassing: a) sources of obligation (unilateral promises, negotiorum gestio, undue payment, unjust enrichment); b) real guarantees (not the personal ones, that are part of the course of Istituzioni di diritto privato II); c) system of land registration (in the broader context of the circulation of rights).

(reference books)
(1) Introduction to private law (3 cfu) The first module of the course deals with the concept of juridical norm and with the sources of law (particular attention is given to the European level of normative production, and to the relevance of the Constitution in private-law relationships). The course then analyzes the subjects of private law, and the main categories of legal situations abstractly available to them (examining, here, prescription and forfeiture). (2) The obligation in general (2 cfu) The second module deals with the law of obligation in general. In particular, the following topics are examined: (i) the sources of obligations (with specific attention, here, on legal sources different from contracts and torts); (ii) the main types of obligations (with particular attention to pecuniary obligations); (iii) modifications of the active and passive side of the debtor-creditor relationship; (iv) the extinction of the obligation (exact fulfillment and different methods of extinction); (v) the debtor's liability (with reference to the third module, on contractual remedies). (3) The contract in general (3 cfu) The third module deals with the law of contract in general. In particular, the following topics are examined: (i) the notions of contract and of private autonomy (typical and atypical contracts; references to consumer contract); (ii) the essential and accidental elements of the contract; (iii) the conclusion of the contract (with analysis extended to pre-contractual liability and to representation); (iv) the effects of the contract (in particular: rules for interpretation and integration, and reference to the fourth module); (v) the simulation; (vi) contractual invalidities (references to consumer protection); (vii) damages for non-performance (viii) termination of the contract. (4) Protection of rights (2 cfu) Based on the concepts examined in previous modules, the fourth and final part of the course examines the following topics: (i) patrimonial liability (in relation to which the following topics are analyzed: real security rights; the judicial means of preserving patrimonial guarantee); (ii) land registration (with reference to the effects of contract in the the circulation of wealth). A) The latest edition of the textbook:

(syllabus)
The course of Institutions of Private Law II is aimed at allowing students the critical deepening of some typical institutions of private law understood as that complex of rules that govern the intersubjective relationships between the individual members in their patrimonial sphere but also personal and family. Particular attention will be paid to the right of people - physical and legal - to which the system recognizes the quality of subjects of law, that is, holders of active and passive legal situations. Family law will also be studied in depth, consisting of a set of legal rules that concern not only the traditional family based on the marriage of a heterosexual couple, but also civil unions between persons of the same sex and de facto cohabitation, recently debated reforms. The law of succession will also be addressed, whose provisions are aimed at regulating the personal and patrimonial relations of the individual after death, and the subject of real rights, that is rights over things, with particular reference to the ways of purchasing and of transfer of the right of ownership between the living, as well as the real rights of enjoyment, possession and usucation. A special look will also be given to some special contracts (sale, lease, lease, sale and lease back, factoring, franchising, contract, mandate, deposit, loan, mortgage, transaction, consumer contracts) and finally to the delicate issue of civil liability, the complex of illicit facts to which a compensation obligation arises for those who have caused unfair damage.

NAPOLITANO GIULIO
(syllabus)
The course is divided into five teaching modules.
(reference books)
In the first, the different administrative functions and their impact on the lives of citizens and businesses are analyzed. In the second, the organizational design of the public organization is reconstructed, noting that each organizational model is marked by a different "logic of collective action." In the third module, the different manifestations of administrative action are examined, highlighting, in particular, the characters of administrative power and discretion and the areas of contractual autonomy. In the fourth module, the study of the different techniques of regulation of administrative action, both authoritative and contractual, aimed at ensuring the pursuit of the public interest and avoiding abusive behavior of the public administration to the detriment of private parties is explored. In the fifth (and final) module, the means of protection provided by the legal system for individuals who complain about the violation of their rights and interests are highlighted. The exposition of the discipline of the subject will be conducted through the collective discussion of practical cases and judgments, highlighting the legal framework, the strategies pursued by the various actors, the outcome of the judgment, its concrete consequences and the underlying general problems. There are two texts for exam preparation: the textbook and the case collection.
The recommended textbook is the following: G. Napolitano, "The Logic of Administrative Law," Bologna, Il Mulino, 3rd ed., 2020. An initial reading of the textbook in advance at the beginning of the course or, at any rate, of individual lectures is highly recommended. In fact, the study of the logic of administrative law is a prerequisite for a better analysis and understanding of the legislative texts, cases and strategies of administrative law that will be discussed in the classroom. The collection of cases is: G. Napolitano (ed.), "Cases and Strategies of Administrative Law," online publication, 6th ed., 2023. This is a guided collection of cases and judgments curated by the lecturer and chair associates that will be available online on the Elearning platform. Prior reading of the texts and cases to be discussed in the corresponding lecture is recommended. The course provides different treatment between attending and non-attending students for the purpose of passing the exam. |

CIVIL PROCEDURE I
(objectives)
Civil procedure attends to dynamic field of judicial experience; the one is affirming the existence of rights, the other is their effective being and peaceful practice. Whether a right is denied or its practice is forbidden, we need effective redress devices. Civil procedure attends to relationships between claimant and defendant. Before studying how proceedings are regulated, however, we need to describe the aim which they can pursue, that is protection forms, which overlap to different kinds of manageable action. We need to specify prerequisities of Courts before which the proceedings is brought, as well as qualities of parties involved in the proceedings, and devices that each of them can use. These general topics concern the first part of the course. In the second and third part we will examine rules of ordinary proceedings before lower courts and appeals.

Economics (Global legal studies)
(objectives)
The purpose of the course is to make graduates in legal disciplines able to understand the economic impact of laws and institutions through a comprehensive understanding of the basic mechanisms driving economic systems. Student will acquire the analytical tools and the basic knowledge necessary to understand and interpret the economy. Starting from the microeconomic analysis of individual behavior of consumes and firms, the course will then study the effect of interactions among economic agents and the market equilibrium. Building on the microeconomic background, it will then analyze the evolution of the main macroeconomic variables – GDP, imports and exports, unemployment, inflation, interest rates – and the impact of the two major instruments of intervention of economic policy: fiscal and monetary policy.
The presentation of the main macroeconomic theories will take place mainly in graphic form and with the help of simple formal models. It will be accompanied by examples and references to the performance of the real economy that will allow students to better understand how the models can be used to interpret the evolution of the economy and the impact of the different economic policy options. The aim of the teaching is to increase students' knowledge and their ability to understand economic phenomena independently, providing the ability to follow the ongoing debates and the possible alternative policy options, developing an independent judgment. The student will also learn to communicate critically within and outside its working context the results of his analysis of the major economic trends and the main effects of the alternatives offered by economic policy.

DALLA MASSARA TOMMASO
(syllabus)
The Roman Law course will be carried out through the analysis and discussion of specific cases.
(reference books)
In particular, problems arising from each case will be treated in a diachronic comparative perspective, making comparisons between the approach adopted by Roman jurists and the contemporary legal regime, with specific regard to the Italian and other European legal systems. The first part of the course will be focused to an in-depth study of the casuistic method, in relation with the analysis of the role of the “regula iuris” held in the Roman jurisprudence, which followed the development of the Roman legal system up to the post-classical period. With specific regard to the evolution of the sources of Roman law, the study will take a close look at the main stages of history of jurisprudence. The second part of the course will be offered through seminar meetings, often in open dialogue with Italian and foreign guest lecturers. Liability will be the main focus of this part of the course: what does liability mean? How did the idea arise in the thinking of Roman jurists? What legacy has the Roman reflection upon liability left for today’s European private law? In order to gain proper understanding of the mechanisms that used to lead to the outcome of a “condemnatio”, the issue of liability in Roman civil proceedings will be addressed form both a contractual and a non-contractual point of view: respectively when the subject failed to fulfil an obligation and in case of torts. Particular attention will be paid to the procedural profile. Program First part (reference text: F. Schulz, History of Roman legal science, Oxford, 1953; P. The course is aimed at providing the students, through a monographic study of the juridical phenomenon about the divergence between the wanted crime and the realized one, with instruments for a dogmatic and criminal-politic analysis, in an advanced and specialized way, of some of the main institutes of the general theory of crime, such as intention, negligence, unintention, mistake in fact – in particular, as to the specializing elements -, the so-called “aberratio”, the fortuitous event and the force majeure as general limits to the “personal” criminal liability. Critical Perspectives On Private Law(Global Legal Studies)
(objectives)
The course “Critical Perspectives on Private Law” will focus on the field of Contract Law.
In a traditional course of studies in law, students are mainly exposed to domestic contract law, taught in their own language. This course assumes that contract law is a transnational discipline that can be taught not only on the basis of domestic law but also on the basis of common (transnational) foundations (principles and methods). In exploring the common foundation of transnational contract law, the course will explain how, these days, contract law is the product not only of national and international regulations but also of “private lawmaking”.

MARELLA MARIA ROSARIA
(syllabus)
The course will explore the main fields of private law, such as property, contract, torts and family law - and related legal concepts - from the critical perspectives elaborated by different schools of thought and movements like Legal Realism, Critical Legal Studies, Feminist Legal Theories and Queer Legal Studies.
(reference books)
Students will cope with different methods of analysis that unveil the ideology that lies beneath the supposed neutrality and abstraction of private law technicalities. The course ultimately aims at shedding light on the ways in which private law not only affects social, economic and gender relations but also directly and indirectly creates the identity of social actors by establishing the rules of the game and distributing economic resources and symbolic power. To this purpose special attention will be paid to the re-reading of the fundamental institutions of classical legal thought (contract, torts, property and family) offered by critical scholars and particularly feminist legal scholars.
