CONSTITUTIONAL LAW
(objectives)
The course – which is preliminary to all other courses in public law – aims at offering the acquisition of the fundamental elements of institutional nature in the domain of public law, and provide an overview on the matters that characterise our legal system. Furthermore, the course is also aimed at the deepening of issues connected with the judicial concept of security, in its different declinations and in light of its incessant evolution. The relationship between security of rights and the right to security will finally be examined, against the background of constitutional law.

General part The general part of the course is aimed at the examination of the essential aspects of the organization of the State, the characteristics of the legality of the government, the distribution of public establishments, the sources of law, the issues connected with the involvement of Italy in the European Community and the European Union, the arrangement of national territorial autonomy. Futhermore will be given particular attention to the foundamental rights protection, in connection with the effective guaranties to provide the effectivity of the mentioned protection, public administration activities, and the origins, the models and the developement of Constitutional Justice. Special part The special part of the course is aimend at the deepening of the issues connected with security on a legal perspective, especially on the undertones and the incessant evolution of the argument. Always caring about the national and supranational view, further attention will be given to the issue of security, both as a guarantee and as a potential limit of founamental rights. The security guarantee will be examinated in respect of the form of governament, of the diffrent dimensions of territorial security and of the issues connected to information transparency, especially cybersecurity. Futhermore, the juridical challenges given by new technologies will be examinated with particular reguard to the link between security and Artificial Intelligence, security and Internet, security and Big Data management.

The course aims at introducing the student to the knowledge and comprehension of the foundations of private law, i.e. the fundamental concept and legal rules governing private law relationships between individuals and corresponding remedies.

The course analyzes the historical evolution of Roman Private Law from its origins to the Justinian age. The Roman Private Law’s main topics are: 1. General historical framework (2 h); 2. Sources of Roman Law (8 h); 3. Civil procedure (18 h); 4. Individuals and family (2 h); 5. Facts, acts and legal acts. Obligations and contract law (12 h); 6. Ownership, possession, other rights in rem (6 h); 7. Inheritance law (2 h). The main purpose of this course is to explain the elementary discipline of the institutes created by the Roman legal science. The course also aims to encourage students to analyze specific legal issues: students should become familiar with the methodological tools needed to apply theoretical knowledge to private law issues.

The course will focus on the conflict between different philosophical models of interpreting law and criminal law in particular. The teaching objectives are: a) to provide students with the theoretical tools necessary for the deep analysis of the legal system, with a focus on criminal law; b) to allow them to orient themselves in the panorama of philosophical and theoretical reflection on criminal law, through an analytical exposition of the theory of guarantee, starting from Cesare Beccaria. Finally, attention will be paid to the great questions around punishment: why, who, how and when to punish.

Sicurezza e mantenimento della pace
(objectives)
The course on Maintenance of Peace and Security falls into the didactic activities in the field of international law offered within the Corso di laurea in Servizi giuridici per la sicurezza territoriale e informatica. The course aims at offering to students a critical knowledge of the legal framework concerning the maintenance of international peace and security, in order for them to: (i) get acquainted with the main actors (in particular, the United Nations) and the fundamental rules concerning the use of armed force, the collective security system, the law of armed conflicts and international criminal justice; (ii) have the capacity to understand current phenomena strictly linked to the overall aims of the Corso di laurea, including international terrorism, the use of cybernetic force, the status of military personnel deployed abroad, the compatibility of the use of intelligence material with international law, etc. At the end of the course, students know and understand mentioned phenomena and are able to critically assess them.

The course introduces students to the basic rules concerning the maintenance of peace and international security. The course is divided into four parts. It considers the fundamental legal characteristics of the following issues: (i) use of force in international law; (ii) the United Nations collective security system; (iii) law of armed conflicts; (iv) repression of crimes under international law. In particular, each part addresses the following topics:
Part I: use of armed force in international law: - Prohibition of the use of armed force in international law - Self-defence and humanitarian intervention - Focus on use of force and cybernetic attacks
Part II: the United Nations collective security system: - Use of armed force authorized by the United Nations - Peacekeeping operations - Focus on measures to counter international terrorism
Part III: law of armed conflicts: - International armed conflicts - Non-international armed conflicts - Focus on troops sent abroad and on their status
Part IV: international criminal justice: - War crimes, crimes against humanity, the crime of genocide and the crime of aggression - International criminal courts and tribunals - Focus on terrorism as a crime under international law

Indagini penali informatiche e digital evidence
(objectives)
The course aims to provide students with a complete picture of the investigative activities concerning computer and telematic data and, more generally, the intersections between digital data and criminal proceedings, through the analysis of the relevant legislation and the most relevant jurisprudential approaches. Particular attention will be paid to the critical in-depth study of the criminal procedural law regarding digital evidence and the specific logics that govern the acquisition and the assessment of digital evidence in the context of criminal proceedings. The aim of the course is to stimulate students to compare the classic categories of Criminal Procedural Law with the problems posed by the use of technological tools, in order to acquire a useful wealth of specialist knowledge in the field of digital forensics that may be used, in the future, in the field of legal professions or in the field of those activities that are related to the issue of security.

The course will address the issue of the use of digital evidence in criminal proceedings. A first part will deal with the systematic framing of digital evidence, with particular reference to its relations with scientific evidence and documentary evidence, and to its most relevant and current implications, including references to practical cases. An analysis of the means for obtaining digital evidence will follow, with specific regard to wiretapping and the use of trojans in the criminal trial. Particular attention will be paid to the question of the impact of digital investigations on the fundamental rights of the citizen.

The matter on "consumer safety" is divided by placing the consumer, in the plurality of figures, at the center of economic reality, with constant attention also to the legislation of constitutional rank. The Consumer Code is analyzed, from sources to information obligations, to the figure of the consumer in the digital market, to unfair commercial practices, to the formation of the contract and withdrawal, to the unfair clauses, guarantees in the sale, online and distance contracts, contracts with financial intermediaries, the consumer - debtor, producer liability and product safety, class actions, alternative methods of dispute resolution, to move on to the analysis of specific contractual figures (package travel agreement, timeshare, credit agreement, the sale of consumer goods).
