In the progress of time, a considerable number of international treaties and European Union Regulations introduced new rules that replaced conflict rules of purely national origin. This trend towards an ‘internationalization’ is aimed at building uniform conflict of law rules and a common system of rules on jurisdiction, mutual recognition and enforcement of judgments and decisions. At the end of the course students should be able to reach a basic understanding and to critically discuss cases of private international law.

To understand the basic practical and historical reasons for the development of international arbitration as a means of dispute resolution in international trade. – To develop a thorough knowledge of the main international instruments for the harmonisation of international arbitration worldwide. – To understand the importance of the “lex arbitri” and to acquire a satisfactory degree of familiarity with the provisions of several domestic arbitration statutes. – To become familiar with the different available types of arbitration. – To understand the fundamental principles governing the validity of arbitration agreements. – To identify scope and limits of the jurisdiction of arbitral tribunals. – To acquire the ability to draft different arbitration clauses in the presence of different scenarios. – To acquire the ability to analyse pre-drafted arbitration clauses and to identify potential difficulties. – To become acquainted with the main issues relating to the conduct of arbitration proceedings in different jurisdictions and under the arbitration rules of different arbitral institutions. – To acquire the practical ability to prepare written submissions and to develop sufficient skills to perform basic oral advocacy tasks. – To become familiar with the main issues connected to the gathering of evidence in international arbitration. – To develop sufficient knowledge on recognition and enforcement of arbitral awards. – To become familiar with the main peculiarities of foreign investment arbitration.

The course "European Criminal Law" aims to examine the progressive influence on the national criminal law by European law, that include the EU law and the ECHR system. Until a few decades ago the combination of "European law" and "criminal law" appeared almost an oxymoron. The system of sources of law is conversely today more complex and labyrinthine and, at least in some respects, it is gradually changing the face of criminal law, that seemed like the more solid articulation of national sovereignty.
The lessons will be developed following the main theme of the principle of legality in criminal law, in its articulations of the legislature's exclusive power to create crimes, the principle of determinacy and the principle of non retroactivity of criminal law (supplemented by that of the retroactivity of more favorable law): the objective it is to examine the metafomorphosis of the criminal legality, especially as a result of European jurisprudence. The course will also try to focus on the significant changing of the Italian system of sanctions as a result of the europeanisation of criminal law, on the side of the "double track" between criminal penalties and security measures and on the side of the compresence of criminal and administrative sanctions. The last part of the lessons will examine the "multi-level" protection of human rights, which is one of the challenges still open to real integration (juridical) European.

The course is designed to give the tools to help students to approach universal and regional mechanisms of human rights protection. The course on "International and European Disaster Law" is supported by the EU Commission in the framework of the "Jean Monnet, Erasmus+" Programme. It aims to foster knowledge on the international and European legal framework concerning response and prevention to disasters in light of the increasing relevance of such issues for main stakeholders (International organizations, NGO, Red Cross Movement, private actors) involved in activities aimed to support affected individuals and communities.
The course, apart from a series of frontal lectures, will follow an interactive didactic approach through: meetings with institutional representatives and members of NGOs dealing with disaster scenarios; thematic seminars, use of digital databases, analysis case-studies to test legal issues in time of disasters.

Focus: International Humanitarian Law Legal Clinic
The “International Humanitarian Law Legal Clinic” (IHL Legal Clinic) has been established in order to permit students involved in the IHL course of the Law Department to cooperate on a pro bono basis on research projects of relevant stakeholders operating in this area and acquire significant skills beneficial for their competences and future activities. The IHL Legal Clinic is inspired by a ‘learning by doing’ approach permitting students to develop their competences in legal research, drafting, writing and organization of activities on the basis of knowledge acquired in their academic curricula, in particular through the international humanitarian law course, in order to facilitate the transfer of theoretical analysis into a practical perspective. Creativity and autonomy is encouraged as well as the capacity to cooperate in small working teams able to act through largely independent research and writing. The overall coordination and support to students is provided by the IHL professor (Giulio Bartolini) and other collaborators to this chair (Dr. Tommaso Natoli).

In particular, through the analysis of real cases, both from Italy and the United States, students are put in the condition to investigate: a) the factors that can lead to the miscarriages of justice; b) the institutes provided by the Italian judicial system in order to remedy the conviction of an innocent. The activity is characterized by a comparative perspective, and it is carried out within the Italy Innocence Project, coordinated by prof. Luca Luparia and part of the Innocence Network of New York.

The aim of the seminar is to render students aware of the social, economic and legal aspects of one of the most innovative areas of information and communication technologies (ICT). Data have been qualified as the “new oil” of contemporary societies. Although the expression may be misleading, surely the next years will be marked by an enormous development of technologies able to collect, store and process amounts of data which are, for the moment, enumerable in billions of billions. This will be due not only to the increasing use by individuals of ICTs which will record very activity, but also by the dissemination of so called “Internet of the things”, i.e. objects, from extremely complex as an automobile, to extremely simple, as a food product, that will provide in real time information on their location, their environment, their use. This can be an extraordinary opportunity for development – commonly defied as “Data-driven innovation” - but it presents also challenges that lawyers will have to face and try to resolve, such as the philosophical issues of self-determination and of free-will; in what legal category does data fall; the application of data protection laws; the contracts concerning the collection and trade of data; intellectual property rights over data and competition concerns. These are only some of the topics which will be presented and discussed in the seminar.
