GENERAL THEORY OF THE LAW
(objectives)
The course of General theory of law intends to illustrate the lawyer’s activity, with the premise that it is a communicative experience. Obscurity and vagueness of norms are the most serious problems within the ambit of the law. However, this problem is common to all the communicative processes and can be overcome by integrating the message (here the norms) in a specific context, that provides the information necessary to understand the text. Within the context of law, more specific problems arise. On one side, the “text” is formed by the set of all norms, therefore it has disproportionate dimensions. On the other side, the context must be analysed with methods directed to simplicity and intelligibility. Jurists have been overcoming these obstacles resorting to several instruments: Systematic analysis of the set of rules; Hermeneutic traditions; Legal logic; Economic analysis of law; The reconstruction of practical scenarios; Commutative, distributive, retributive justice principles; Resort to common sense; And so on.

Particular attention will be dedicated to the evolution of English constitutionalism, which deals with different theoretical and practical profiles with respect to those relating to French, German and Italian constitution experiences.

The course "European Criminal Law" aims to examine the progressive influence on the national criminal law by European law, that include the EU law and the ECHR system. Until a few decades ago the combination of "European law" and "criminal law" appeared almost an oxymoron. The system of sources of law is conversely today more complex and labyrinthine and, at least in some respects, it is gradually changing the face of criminal law, that seemed like the more solid articulation of national sovereignty.
The lessons will be developed following the main theme of the principle of legality in criminal law, in its articulations of the legislature's exclusive power to create crimes, the principle of determinacy and the principle of non retroactivity of criminal law (supplemented by that of the retroactivity of more favorable law): the objective it is to examine the metafomorphosis of the criminal legality, especially as a result of European jurisprudence. The course will also try to focus on the significant changing of the Italian system of sanctions as a result of the europeanisation of criminal law, on the side of the "double track" between criminal penalties and security measures and on the side of the compresence of criminal and administrative sanctions. The last part of the lessons will examine the "multi-level" protection of human rights, which is one of the challenges still open to real integration (juridical) European.

The course "Protection of personal data and protection of fundamental rights - Privacy Law Clinic" (ECTS), from a Public Law perspective, allows the students to engage in practical activities, based on the theoretical lessons of the first part of the course, according to the "learning by doing" method. The idea for the course comes from the awareness that the fundamental rights are now an established heritage of our legal tradition, both at national and european level: we now appreciate a multi-level protection of fundamental rights, made possible by the constitutional clauses that allow the opening to international and European Law. In this context, the right to privacy, codified by the Privacy Code (Legislative Decree. N. 196/2003), is a fundamental human right, as a direct explication of dignity, also due to the contribution of Eu Law and ECHR. Therefore, the right to privacy, both in the tradional sense and as protection of personal data, has now achieved a solid legal acknowledge: first of all, we should consider articles 7 and 8 of the EU Charter of rights and case law of both the Court of Justice and the Court of Strasbourg. Secondly, we need to mention EC (noe EU) Law, beginning with the Directive 95/46/ EC, folowed, at the national level, by law n. 675/1996 and then by the so-called Privacy Code (Legislative Decree no. 196/2003). Finally, the need for a more coherent framework at European level has led to the adoption of the new Regulation on data protection (EU Regulation 2016/679), which, by repealing Directive 95/46, produces a fundamental work of standardization of the national laws on the subject. Once descrived the theoretical framework, there are two theoretical and practical focus on the legal framework (Legislative Decree. N. 196/2003 and EU Regulation 2016/679) and the activities of Data Protection Authority. Such focus are the necessary link between the theoretical and the practical part, represented by a legal service to the administrative staff of the University. This activity will be conducted under the supervision of a teacher (and student graduating seniors / graduates), by students who have demonstrated the necessary theoretical knowledge.

The main objective of the course is to present these reasons to the students as well as the main objections that can be addressed to them. The underlying assumption is that too often the positions and proposals about the role of markets in society, be they of praise or blame, reflect ideological biases. A considered reflection is essential to understand the attractiveness and the limitations of an institution as important as the market is.

The first module (30 hours) of the course aims to provide students with the tools needed to understand the functioning of monetary economy and the operative aspects of Central Bank monetary policies. It explains what money is, the debate on its origins, the different approaches to the determinants of the demand for money and its supply, monetary policy instruments and equilibrium in the assets markets. The lectures of this first module will be held in Italian. The second module (30 hours) concentrates on the relations between money, prices and outputs in the long and short run. It also analyses the debate on rules and discretion in monetary policies, the Taylor rule and the sustainability of public debt. These themes are developed according to both a traditional and heterodox approach. A knowledge of basic microeconomic and macroeconomic notions is a prerequisite for this second module.

The object is to explore the combination, influence, and competition between legal norms and regulatory criteria produced in other spheres of social life and by the doctrines that belong to those spheres. From this perspective, the encounter between law and religion serves to illustrate the formation and functioning of the principles and norms which structure not only the relations between subjects with respect to one another, but also their relation to earthly and heavenly things.
