The course aims at offering an interpretation of the penitentiary law according to the terms of the Constitution, with a both theoretical and practical approach, particularly focused on the application of rules in the practice and in the jurisprudence, at national level and beyond. Based on this point of view, in which the “constitutionalistic” shade prevails, the course means to enlarge the cultural baggage of our students, combining the knowledge they already got in different fields (constitutional law, philosophy of law, criminal law, rules of criminal procedure, international law, ecc.) with the basic teaching of our degree course. In collaboration with Associazione Antigone, students will participate to the activities promoted in the legal Support Helpdesks that already exist in Rome’s prison facilities.

Se analizará, estructurará y aplicará los instrumentos, convenios y declaraciones que ofrecen el Derecho Internacional y Nacional a casos concretos, como la protección de nacionales en el extranjero.
-Se distinguirá los ámbitos de aplicación del Derecho Diplomático y del Derecho Consular.
-Se estructurará las relaciones del Derecho Diplomático y Consular con otras ramas jurídicas y no jurídicas, tales como la Política y las Relaciones Internacionales.
-Se analizará detalladamente los instrumentos internacionales, tanto consuetudinarios como convencionales, que regulen las funciones diplomáticas y consulares.
- Entre ellos e analizará la Convención de Viena sobre Relaciones Diplomáticas de 1961 y sobre relaciones Consulares de 1963.
-Se analizará los avances, logros y tendencias prevalecientes en materia diplomática y consular en el mundo contemporáneo, incluyendo a los organismos intergubernamentales. Estudio y anàlisis de casuìstica.

L’attività formativa ha come obiettivi l’illustrazione delle principali teorie dei diritti presenti nel dibattito italiano e internazionale e la discussione, sulla base delle conoscenze acquisite, di singoli casi controversi. Particolare attenzione sarà dedicata alla riflessione teorico-giuridica circa la funzione specifica dei diritti, la determinazione dei loro titolari, il loro fondamento giustificativo. Il corso è suddiviso in tre parti: la prima relativa all’illustrazione delle origini storiche e concettuali dell’età dei diritti; la seconda relativa alla presentazione delle principali teorie dei diritti; la terza relativa alla discussione seminariale delle questioni teorico-giuridiche e filosofico-politiche poste da selezionati casi controversi.

(objectives)
The course aims at applying the “learning by experience” methodology to women’s rights, with a particular focus on social identity (especially linked to labor) of migrant women in Italy. The case-studies will mainly concern the municipality of Rome. The methodology, which integrates a theoretical perspective (both legal-philosophical and legal-historical) and a practical activity by means of a legal helpdesk, aims at developing a theoretical analysis of concrete, individual experiences.

The course intends to introduce students in an extremely important area of EU law. In particular, it is aimed towards students being able to: i) demonstrate knowledge of EU competition law, taking a critical look at competition policy and its development; ii) deal with the primary sources of EU competition law (legislation, Commission decisions, CJEU/GC rulings); iii) carry out a presentation and a discussion on a competition law topic.
