Il seminario si propone di divulgare, con tecnica seminariale, temi fondamentali relativi a una delle questioni giuridiche più controverse del nostro tempo – la lotta al terrorismo internazionale. Esso nasce grazie alla collaborazione fra la Facoltà e il Centre for the Politics of Transnational Law dell’Università VU di Amsterdam. L’obiettivo dei seminari è quello di studiare (i) le risposte giuridiche sia preventive che repressive al terrorismo adottate a livello internazionale, regionale e nazionale (con un focus sull’ordinamento italiano), (ii) le interazioni fra i descritti diversi livelli ordinamentali, (iii) le relazioni fra tali risposte e le norme di diritto internazionale sia di rango pattizio che consuetudinario (in particolare, quelle poste a tutela i diritti umani) e (v) i rimedi a disposizione di coloro che vogliano contestare le sanzioni loro imposte sia da parte del Consiglio di Sicurezza delle Nazioni Unite che, regionalmente, da parte dell’Unione europea in modo autonomo.

The course aims at offering an interpretation of the penitentiary law according to the terms of the Constitution, with a both theoretical and practical approach, particularly focused on the application of rules in the practice and in the jurisprudence, at national level and beyond. Based on this point of view, in which the “constitutionalistic” shade prevails, the course means to enlarge the cultural baggage of our students, combining the knowledge they already got in different fields (constitutional law, philosophy of law, criminal law, rules of criminal procedure, international law, ecc.) with the basic teaching of our degree course.

THE COURSE PROVIDES AN INTRODUCTION TO THE STUDY OF COMPARATIVE ADMINISTRATIVE LAW FOR BOTH THEORETICAL AND PRACTICAL PURPOSES. ON ONE SIDE, THE COURSE OFFERS AN INTELLECTUAL FRAMEWORK TO BETTER UNDERSTAND THE ROLE OF GOVERNMENT AND THE DIFFERENT REGULATORY TECHNIQUES EXISTING IN VARIOUS JURISDICTIONS, AT NATIONAL AND SUPRANATIONAL (E.G. EU, WTO) LEVEL. ON THE OTHER SIDE, THE COURSE PREPARES FUTURE LAWYERS AND CONSULTANTS TO PROVIDE ADVICE TO COMPANIES AND TO INVIDIDUALS ON INVESTMENT, BUSINESS AND POLICY-MAKING DECISIONS, IN RELATION TO THE DIFFERENT LEGAL AND ADMINISTRATIVE FRAMEWORK OF EACH JURSDICTION.
