20110016 - ATTIVITÀ: MEDIAZIONE E NEGOZIAZIONE DEI CONFLITTI NEI RAPPORTI D’IMPRESA (objectives) OBIETTIVI L’approfondimento delle tecniche di mediazione e di negoziazione ha come obiettivo di offrire agli studenti: 1) Una qualificata formazione giuridica sulla normativa italiana che disciplina il ricorso agli strumenti di ADR (Alternative Dispute Resolution), e cioè di risoluzione dei conflitti alternativi alla giurisdizione ordinaria soffermandosi, in particolare, sulla conoscenza della mediazione e delle sue tecniche di gestione, utilizzando un metodo di apprendimento basato sulla esperienza pratica e sulla simulazione; 2) Di sviluppare consapevolezza sulla modalità di gestione del conflitto e sulla scelta dei metodi previsti dall’ordinamento italiano per la sua risoluzione; 3) Di Sviluppare le tecniche fondamentali di gestione del negoziato nell’ambito di una mediazione civile e commerciale	2		20	-	-	-	Other activities	ITA
20110017 - ATTIVITÀ: CRISI DEL DEBITORE CIVILE E TUTELA ANTICIPATA DEL CREDITO (objectives) L’attività formativa si propone di illustrare ed analizzare lo stato attuale della legislazione nazionale ed europea in materia di crisi del debitore civile e tutela del credito. La parte teorica è focalizzata sulla disciplina del sovraindebitamento; l’analisi verrà condotta sia nella prospettiva del debitore sia in quella diversa degli intermediari creditizi. L’obiettivo è quello di comprendere la rilevanza sistematica della nuova procedura elaborando un quadro completo dei rimedi posti a presidio del credito in fase dinamica al fine di prevenire il fallimento del piano obbligatorio. La parte più spiccatamente pratica dell’attività intende, invece, offrire agli studenti un “laboratorio” in cui apprendere la gestione della composizione della crisi da sovra indebitamento, a seconda della procedura applicabile, simulando ed attuando gli interventi che gli Organismi di Composizione della crisi (OCC) sono a chiamati a svolgere, previa verifica delle relative responsabilità."	2		20	-	-	-	Other activities	ITA

The global political agenda and the tensions between Developed and Developing Countries at the time of decolonization. Inter-State disputes relating to acts of expropriation and/or nationalization of foreign investments in host Developing Countries. Legal sources of International Investment Law. The multiplication of treaties in the field of investments: an analysis of a investment model treaty. The lack of human rights’ safeguards in the investment treaties of first generation. The so-called direct arbitration as an instrument for the settlement of disputes between States and foreign investors. The protection of fundamental rights in the arbitration case law. La parte teorica è focalizzata sulla disciplina del sovraindebitamento; l’analisi verrà condotta sia nella prospettiva del debitore sia in quella diversa degli intermediari creditizi. L’obiettivo è quello di comprendere la rilevanza sistematica della nuova procedura elaborando un quadro completo dei rimedi posti a presidio del credito in fase dinamica al fine di prevenire il fallimento del piano obbligatorio. 20101035 - TAX LAW (objectives) The course in tax law aims to provide students with the theoretical basics for the approach to the study of the tax legal framework and to allow the deepening of the legal structure of the tax system. The course is divided into a general and a special part. The general part focuses on the study of the general principles of tax law, through the analysis of both its structure and implementation, and examining the relevant violations and tax litigation remedies. 20101271 - HISTORY OF MEDIOEVAL AND MODERN LAW (objectives) The course aims at illustrating, through a critical approach, the long journey of European and Western legal history between the Late Antique and the Modern Period. Starting from a description of the social, political and economic context, the legal institutions will be analyzed in their historical dimension, focusing the attention on legislation, on jurisprudence, and on the effects they had on case law. The lessons will be divided into two modules: 1) Middle Ages (3rd-15th cent.) and 2) Modern Era (16th-19th cent.). This chronological subdivision is justified by the elements of novelty that marked the transition from one era to another. 20101107 - CIVIL PROCEDURE I (objectives) Civil procedure attends to dynamic field of judicial experience; the one is affirming the existence of rights, the other is their effective being and peaceful practice. Whether a right is denied or its practice is forbidden, we need effective redress devices. Civil procedure attends to relationships between claimant and defendant. Before studying how proceedings are regulated, however, we need to describe the aim which they can pursue, that is protection forms, which overlap to different kinds of manageable action. We need to specify prerequisities of Courts before which the proceedings is brought, as well as qualities of parties involved in the proceedings, and devices that each of them can use. These general topics concern the first part of the course. In the second and third part we will examine rules of ordinary proceedings before lower courts.
