20110485 - Legal Clinic on Migration and Asylum (objectives) The course aims to train students in immigration and asylum law, combining theoretical and hands-on approaches, according to a methodology known as learning by doing in the long-standing tradition of U.S. clinical legal education. The purpose of the course is to provide students with adequate knowledge of Italian, European, and international laws on migration and asylum, focusing on the most relevant aspects for the daily lives of migrants and asylum seekers. The lessons are practice-oriented and start from the requests from the clients of the Clinic’s legal service (sportello legale). The second module provides an introduction to the critical debate on migration and borders in order to acquire theoretical tools for the critical reflection on migration and migration policies. Finally, the internship at the Clinic's legal service is a necessary completion of the educational experience, and it is required for students to earn university credits (CFU). The internship facilitates direct contact with clients and allows students to follow up on the case from the identification of the relevant legal issue, under the supervision of the professor and expert lawyers. 20110476 - Comparative Competition Law (objectives) This course, taught in English, focuses on competition law from a comparative perspective (with particular reference to the European Union and the United States). It aims to provide students with the tools for understanding antitrust policies and their concrete implementation through the study of EU and U.S. legislation, case law and enforcement practice. In addition to dealing with individual cases, the course includes in-depth study of specific topics related to sectors of interest (including digital markets) and the intersections between competition law and other areas of law, such as intellectual property law. 20101383 - INSTITUTIONS OF PRIVATE LAW (objectives)

The course aims to provide a critical knowledge of the main issues and problems of private law in light of the recent reforms that have contributed to the ever-increasing proliferation of special legislation and the loss of centrality of the civil code. In this perspective, a particular look will be directed to European law, which has led to a radical renewal of the framework of sources by introducing in our system subsystems designed to support, and sometimes replace, domestic law. In this path, the teaching aims to provide 1) a thorough knowledge of the fundamental notions of private law in the Italian and European legislative framework; 2) the ability to contextualise, analyze and critically interpret sources of a different nature (European directives and regulations, our Constitutional Charter, the civil code, the principles of law enunciated by the jurisprudence of the European Court of Justice and the national court); 3) the lexical and conceptual tools necessary for the study of private law and useful for acquiring good exhibition skills in written and oral form. Expected learning outcomes:
- Analysis and in-depth analysis of the main institutions of private law with particular reference to the system of sources, the criteria of interpretation, the right of persons and family, the law of succession, real rights, the regulation of obligations and contracts in general, to typical and atypical contracts and to the civil liability system.
- Acquisition of technical language and a theoretical framework suitable for depicting and ordering the subject matter.
- Ability to interpret the regulatory provisions in full autonomy and to frame the concrete cases, paying particular attention to the main jurisprudential orientations and to the broader European context.
- Ability to identify possible solutions in case of conflict of subjective legal situations through a critical analysis of the main jurisprudential orientations and of the most consolidated doctrinal guidelines in the light of the changed economic, social and regulatory framework.
- Ability to present the acquired knowledge in the field of private relations in a complete and critical way, using an appropriate technical language. Capacity for refutation and comparison.
- Ability to apply and exploit the knowledge acquired during the course in the context of insolvency procedures, conference reports, seminars, professional interviews, masters.

20101479 - LEGAL CLINIC (objectives) The Small Savers Protection Legal Clinic (SSPLC) provides students with a qualified legal education on the legal framework about consumers and small savers protection in the banking and financial sector, especially as regards the enforcement of their rights and the filing of claims before the "Arbitro Bancario e Finanziario" (ABF - for banking issues) and the “Arbitro delle Controversie Finanziarie” (ACF – for financial issues); builds a network cooperation between academics and professionals; promotes knowledge of alternative methods of dispute resolution within the academic community and amongst. Specific aims of the SSPLC is to combine both the clinical approach and the ADR promotion. 20110608 - ADR Law (objectives) The course tends towards an examination of the regulation, function and effects of alternative dispute resolution instruments, with the aim of framing their systematic scope in the system of the protection of rights and investigating the positive regulation of each individual instrument. Attention will be paid on the distinction between autonomous and heteronomous instruments of dispute resolution. Arbitration, mediation, conciliation, assisted negotiation, settlement and inspection settlement will be specifically examined in their respective fields of application. 20110288 - Diritto sindacale (objectives) Educational objectives The course aims, on the one hand, to provide the student with the teaching tools to understand the complex world of Italian trade union law, where, in private employment, the constitutional and legislative sources are intertwined with the rules dictated by collective bargaining, with the industrial relations practices and with the interpretation of jurisprudence in a "regulatory function". 20110291 - Diritto penale del lavoro (objectives) Given the reference to the fundamental notions of general theory of crime, the course aims to provide advanced knowledge of obligations and penal sanctions in the field of hygiene and safety of the workplace pursuant to Legislative Decree No 81/2008, with regard to both position of the individual subjects (employer, managers, supervisors, those in charge of prevention and protection system, qualified physician, workers' representatives for safety, workers, client or project supervisor, coordinators for the planning or execution of the works), even in the case of a contract or works in temporary or mobile construction sites, and to the amministrative liability of legal entities pursuant to Legislative Decree No 231/2001, after examining the most recent jurisprudential guidelines on the matter. As for individual positions, the purpose is to analyze the criteria for the objective and subjective imputation of accident offenses, both contraventional and criminal, with particular regard to manslaughter and culpable personal injury, focusing on the assessment of the guarantee positions, of the casual link and guilt, also in relation to the meaning of art. 2087 of the Italian Civil Code, as well as on the conditions for cooperation in the culpable crime, in light of the validity and effectiveness requirements of the delegation of functions and the limits of the principle of expectation or of the distinctions between senior and subordinate subjects, guarantee and surveillance obligations, operational and organizational control (or "high supervision"), culpa in eligendo and culpa in vigilando. As for the collective body, having examined the imputation referred to in Legislative Decree No 231/2001, the aim is to deepen the techniques for drafting the organizational models, the criteria for assessing the relevant eligibility requirements and effective implementation in relationship to accident prevention obligations and to the various control tools (certifications, quality systems, risk assessment documents, etc.) as well as the methods of composition and functioning of the supervisory body. Particular attention will be paid to the critical analysis of the institutions proposed and the peculiar logic governing the investigation of administrative offences dependent on crime. 20110046 - Diritto Penale Europeo (objectives) The course "European Criminal Law" aims to examine the progressive influence on the national criminal law by European law, that include the EU law and the ECHR system. Until a few decades ago the combination of "European law" and "criminal law" appeared almost an oxymoron. The system of sources of law is conversely today more complex and labyrinthine and, at least in some respects, it is gradually changing the face of criminal law, that seemed like the more solid articulation of national sovereignty. The lessons will be developed following the main theme of the principle of legality in criminal law, in its articulations of the legislature's exclusive power to create crimes, the principle of determinacy and the principle of non retroactivity of criminal law (supplemented by that of the retroactivity of more favorable law): the objective it is to examine the metafomorphosis of the criminal legality, especially as a result of European jurisprudence. The course will also try to focus on the significant changing of the Italian system of sanctions as a result of the europeanisation of criminal law, on the side of the "double track" between criminal penalties and security measures and on the side of the compresence of criminal and administrative sanctions. 20110593 - Law of International Organizations  (objectives) The purpose of the course is to provide an introduction to the principles and norms of international law applicable to the inter-governmental organisations (IGOs). It discusses the essential topics of the law of international organisations, including powers, privileges and immunities, as well as membership rules, institutional structures, and accountability. There is a focus on the United Nations system, as the paradigmatic IGO, including the activities of the specialised agencies based in Rome. Special emphasis is placed on the interaction between universalism and regionalism. IGOs have developed into a pervasive phenomenon: a fundamental objective of the course is to develop a critical understanding of their impact vis-à-vis the current global challenges (economic and financial crises, migration, armed conflicts, disarmament, natural disasters, epidemics). 20110146 - ORDINAMENTO GIUDIZIARIO (objectives) The course aims at examining the Italian legal system field concerning the constitutional principles in matters of judicial function; carrying out a critical analysis of the provisions of the Constitution relating to the judiciary in the light of the interpretation of the constitutional case-law established over time. The structural, organizational and functional aspects of the judicial activity will also be explored. Special emphasis is placed on the analysis of the legislation on the judicial system, from its origins to its latest developments; on the structure of the judicial function, struggling between the unity enshrined in our Constitution and the judicial pluralism fostered by legislative measures enhancing the “exclusive jurisdiction” exercised by administrative courts. At the end of this course, successful students will develop a broad and comprehensive vision of the issues related to the judicial function in a complex legal system, with a particular focus on constitutional law but also considering the close links with the other branches of law (notably with procedural law). 22910225 - WELFARE, SOCIAL RIGHTS AND TERRITORY (objectives) The course aims to provide the students with knowledge and skills that will enable them to know how to frame the organization of public authorities (even in their territorial dimension), the Italian Welfare State system and the constitutional framework of social rights. Furthermore, the teaching purpose is to offer students a reflection on the nowadays condition of people with disabilities, particularly with regard to the detailed study of the disabled people’s constitutional rights and how to effectively protect them. This purpose will be achieved also through the activation of a special Information Desk for students with disabilities, in which the students will be actively involved. By the study of “Welfare, Social Rights and Territory” the student will be able to achieve the following training objectives. Knowledge and understanding: - know how public authorities are organized, including in their territorial dimension; - know models, tools and strategies to realize a Welfare State system; - know the social rights provided for in the Constitution, with particular regard to the rights of disabled people and to the institutional apparatus engaged in guaranteeing their effectiveness; - develop a reflective and project-based attitude towards the current the current implementation of social rights and the rights of disabled people. Applying knowledge and understanding: - plan and organize activities aimed at the effective implementation of social interventions; - apply technical, communicative and relational skills for the realization of activities on the territory, such as the Information Desk for students with disabilities. Making judgements: - develop the capacity to understand and evaluate the organization and activities of the institutional apparatus in particular those which guarantee social rights; - develop a critical and reflexive capacity regarding their own methods of intervention, taking into account the users with whom they deal. Whether a right is denied or its practice is forbidden, we need effective redress devices. Civil procedure attends to relationships between claimant and defendant. Before studying how proceedings are regulated, however, we need to describe the aim which they can pursue, that is protection forms, which overlap to different kinds of manageable action. We need to specify prerequisities of Courts before which the proceedings is brought, as well as qualities of parties involved in the proceedings, and devices that each of them can use. These general topics concern the first part of the course. In the second and third part we will examine rules of ordinary proceedings before lower courts.
