Learning objectives: The course aims to provide the student with full awareness of the limits that criminal law places on the use of social media and communication via the internet for the purpose of protecting both people and public safety. In this sense, both the Italian and supranational legislation on cyber-crime and the principles governing the criminal liability of the operator of online communication media will be explored. All this with particular regard to the different categories of crimes provided for in the Criminal Code and in complementary legislation, the criminal liability of internet service providers, website managers, online newspapers or blogs, both as natural persons and as collective entities pursuant to Legislative Decree no. Bulletin 231/2001.
Expected learning outcomes:
In terms of knowledge and understanding: the student will know the structure of the different categories of computer crimes and the related responsibilities of natural and legal persons.
In terms of ability to apply knowledge and understanding: the student will be able to understand the issues underlying the application of the various computer crimes and the articulation of the related responsibilities as addressed by the most recent case law.
In terms of making judgements: the student will acquire autonomy of orientation and critical analysis skills with regard to criminal liability for computer crimes, in order to conduct professional activities related to computer communication in a correct and conscious way.
In terms of communication skills: the student will be able to promote, through effective communication processes, the knowledge of cybercrime phenomena and the analysis of the related risks for natural and legal persons.
In terms of learning skills: the student will be able to identify, find and critically analyze normative texts, doctrinal sources and case law (leading cases) on computer crimes and cyber crime liability, so as to keep constantly updated on the criminal risks associated with forms of cyber communication.
