(syllabus)
The course consists of two parts. The first part will be devoted to the problem of defining the concept of law and to the main strategies for responding to this problem, with particular reference to the classic theme of the relationship between law and morality and the philosophical-legal conceptions that offer a different reconstruction of it (natural law, legal positivism). The second part will be devoted to illustrating the evolutionary path that has led to the current constitutional state of law, analysing its foundations and most recent transformations, with particular attention to the theme of the so-called administration of rights (structure, logic, function and interpretation of rights; conflicts between rights and their solutions).

The course is divided into three modules: 1) The first module concerns the development of legal philosophical concepts and theories. 2) The second module concerns the concept of law and the theory of the legal system. 3) The third module provides and introduction to the problem of war in critical legal studies and a focus on postcolonial and gender perspective.

The course will introduce the students to the central topics in the philosophy of law (such as the concept of norm, of legal system, of legal interpretation, of legal rights), from the perspective of the evolution of 'constitutionalism', or 'rule of law', from the XVIII century onwards.
