CONSTITUTIONAL LAW
(objectives)
The course examines the following themes: the security of rights and human dignity; the creation of law and, in particular, the relationship between the Constitution and ordinary laws; the Italian system of constitutional justice, with special regard to the interpretation in conformity with the Constitution.

THE COURSE AIMS AT STUDYING THE SYSTEM OF THE SOURCES OF LAW AND OF CONSTITUTIONAL REVIEW. THE ANALYSIS WILL FOCUS IN PARTICULAR ON THE ISSUES RELATING TO THE DEMOCRACY AND TO THE IMPACT OF THE EU LAW ON THE ITALIAN LEGAL ORDER. WE WILL CARRY OUT AN IN-DEPTH STUDY OF THE ISSUES RELATING TO THE CONSTITUTIONAL CONSISTENCY REVIEW, ANALYZING THROUGH THE FILTER OF THE CASE-LAW OF THE CONSTITUTIONAL COURT THE NORMS USED AS A PARAMETER, THE NORMS SUBJECT TO THE REVIEW AND THE DECISIONAL TECHNIQUES OF THE COURT.

Per la preparazione dell’esame si presuppone la conoscenza di un Manuale di diritto costituzionale, riprendendo quanto già studiato nei corsi di Istituzioni di diritto pubblico.

GENERAL PART The creation of law. Constitution, ordinary laws and other sources ok law.Constitutional justice – Constitutional Court: composition, the judgment concerning constitutional legitimacy, conflicts arising over the allocation of powers, charges against the President of the Republic, admissibility of referendums.
SPECIAL PART The interpretation in conformity with the Constitution: the role of the Constitutional Court and the other courts in “doing constitutional justice” for a better protection of rights.

The students are also asked to study the Constitution and the most significant laws on constitutional issues. The Constitution and the above mentioned laws can be downloaded from the Italian institutions’ websites (e.g. www.cortecostituzionale.it; www.parlamento.it ). The knowledge of Public Law course’s contents is required.
For students attending the lectures: For the current academic year it will be developed a specific exam program that will take into account the topics covered during the class. The articulation of the program will be communicated during the first lectures.
