(syllabus)
The discipline seeks to raise awareness and encourage reflection on the theoretical and operational content of social rights, highlighting in particular the correspondence between some of the principles of the legal system and social and purpose of social work. Outline of course - Program Equality and Liberty: the formal concept of Equality and the promotion of Equality The social rights in the Italian Constitution: history and the concept of liberties through the State. The right to work; the rights to social security; the right to health; the right to instruction; the rights in the family context and the rights of children. The limits to the individual liberties, “rights against rights” and the balance. The social right between judiciary branch and legislative branch The duties of economic and social solidarity: work as a duty; the parents’ duties; taxes and fiscal pressure as a social contribution Social rights and type of state: essential social and civil rights standards. The constitutional principle of solidarity as justifying prerequisite for the social assistance system and “helpful relationships” in public field. Social assistance system and Law on social assistance and social services (law n. 328/2000). Social security and welfare state facing the economic crisis. The “helpful relationship”: ethics, law and methodology concerning the effective implementation and individual enjoyment of social rights (psychological counseling, social assistance, instructors, educators and pedagogues). Social solidarity, subsidiarity, volunteering and the so called “third sector”.
