Fundamental rights in their historical and legal evolution. Comparison of different levels of protection in international jurisdictions and Italian law. The inviolable rights. Individual freedoms. The collective freedoms. Social rights as "constitutional rights". Constitutional sources of social rights. Value "axiological" of social rights and "legal pluralism" (Art. 2 of the Constitution as "open case" clause). Community law social rights as a realization of the "Social policy tool". Evolution and guarantee of social rights in Italian law. Concept and historical development of the welfare system. Horizontal subsidiarity and guarantee of social rights. Welfare-mix and constitutional legitimacy of the third sector. Limit to the horizontal subsidiarity. The right to health. The assistance and social security law. The "new rights" and the "new social rights": implementation, current affairs of the Constitution and constitutional jurisprudence. Constitutional foundations, industry regulations and "best practices" of the protection of vulnerable people: children, the disabled and prisoners
