The activity consists of 5 meetings concerning a more detailed and in-depth study of property crime. The same are part of the program of Professor Catenacci's course, but they will not be held in class, but only during the meetings with Dr. Macchiati.
The first lesson will have as its subject an introduction to the systematics of crimes against property within the penal code. In particular, there will be references to the different doctrinal subdivisions of the aforementioned crimes and a study of the concepts of civil law useful and applied by the penal legislator to define the different types of crime (property - property - possession - altruity, etc.). A brief reference will be made below to the minor figures envisaged by the penal code in matters of heritage protection.
The second lesson will deal in-depth with thefts of robbery and theft, through a detailed study of the same and their respective constituent elements. The last rulings of the Court of Cassation in the United Sections will be discussed. The following will deal with crimes of extortion and kidnapping for ransom.
The third meeting will deal with crimes against property through fraud and, in particular, with the crime of fraud. The following will be the crime of usury, with particular attention to the numerous legislative interventions on the subject and to the problem of prescription with respect to this type of crime.
The fourth meeting will deal with the offenses of receiving stolen goods, money laundering, use of money, assets or benefits of unlawful origin and the legislative novelty of the crime of self-laundering. Priority will be given to a study of the problems in the application area and an examination of the latest rulings of the Court of Cassation on the United Sections.
Finally, the fifth lesson will make some important references to confiscation, also as a result of regulatory changes and to some cases of special part that are contiguous and similar to property crime.
Any teaching material will be provided in class or made available to students before the beginning of the meetings.
