PRIVATE COMPARATIVE LAW(DIRITTO PRIVATO COMPARATO)
(obiettivi)
THE AIM OF THE COURSE IS TO INTRODUCE STUDENTS TO COMPARATIVE METHODOLOGY IN THE STUDY AND PRACTICE OF LAW. THE COURSE IS BASED ON CASE-METHOD AND ON A SOCRATIC APPROACH TO THE ANALYSIS OF LAW. STUDENTS WILL BE ASKED TO STUDY AND PRESENT IN THE CLASSROOM CASES FROM DIFFERENT JURISDICTIONS (BOTH OF CIVIL LAW AND OF COMMON LAW TRADITION) IN THE FIELDS OF PROPERTY, CONTRACT AND TORTS. AN IMPORTANT PART OF THE COURSE WILL BE DEVOTED TO THE DEVELOPMENT OF A EUROPEAN IUS COMMUNE THROUGH COMPARATIVE LEGISLATION AND JURISPRUDENCE THE AIM IS THAT THEY ACQUIRE CRITICAL SKILLS WHEN ANALYSING AND INTERPRETING LEGAL CONCEPTS AND RULES. THE IDEA BEHIND THE COURSE IS THAT COMPARATIVE LAW DOES NOT PROVIDE ANSWERS BUT HELPS PUTTING THE RIGHT QUESTIONS.
