JURIDICAL COMPARISON AND STANDARDISATION OF LAW
(objectives)
The course is aimed at providing the students with more-in depth knowledge on legal comparison and uniform law, including the process of legal harmonisation in the frame of the European integration process and at global level. The course examines, in the first part, the theoretical and methodological issues concerning the uniformation/harmonisation process, focusing on the formation of European law, with regard in particular to European citizenship and the protection of fundamental rights as elements suitable to shape a process of ‘integration through rights’ as a basis also for European identity. In the second part, the course examines the issues concerning the wider phenomenon of the so called ‘global law’, with respect to the development of uniform law models and techniques at international level, in the field in particular of intellectual property rights and contractual law.
